§ 170.100 SALARY OF THE VILLAGE MARSHAL.

(A) The salary of the Village Marshal shall be and is hereby fixed at twenty-six thousand and 00/100 annually, to be equally apportioned to each biweekly pay period. The Village Marshal shall fulfill not less than thirty two hours of service each calendar week. Each cumulative period of eight hours of service in which the Village Marshal fails to fulfill in a biweekly pay period shall result in a deduction from the salary fixed herein in the amount of twelve and one half percent.

(B) If the Village Marshal is simultaneously appointed as Village Street Commissioner, he shall be entitled to seventy-five percent of the hourly wage of the Village Street Commissioner in addition to the salary fixed pursuant to this section.

§170.101 SALARY OF DEPUTY MARSHALS.

The salary of deputy marshals shall be and is hereby fixed at thirteen dollars and 75/100 hourly. The Mayor shall, by executive order, annually prescribe the hours of service to be fulfilled by the deputy marshals subject to the maximum public funds appropriated for the compensation thereof.

§ 170.102 AUXILIARY POLICE UNIT ESTABLISHED; EXECUTIVE HEAD; APPOINTMENTS.

(A) Pursuant to section 737.161 of the Ohio Revised Code, there is hereby established the Village of Rutland Department of Police Auxiliary Unit, the executive head of which shall be the Mayor. Police officers receiving an appointment or commission to the Auxiliary Unit shall be classified as certified auxiliary and non-certified auxiliary.

(B) Pursuant to section 737.161 of the Ohio Revised Code, the Mayor shall make all appointments by and with the advice and consent of the Council.

(C) The Mayor may, by executive order, designate a non-certified auxiliary police officer duly satisfying the qualifications set forth pursuant to division (C) of § 170.03 of the Municipal Code, as applicable, as Village Code Enforcement Officer and who shall be accountable to the Mayor in the provision of his duties and responsibilities.

§ 170.103 REGULATION; STATIONING OF PERSONNEL.

Pursuant to section 737.161 of the Ohio Revised Code and subject to the general rules prescribed by the Council by Ordinance, the Mayor shall prescribe rules for the organization, training, administration, control, and conduct of the auxiliary police unit; except that the Chief of Police or Marshal shall have exclusive control of the stationing and transferring of all auxiliary police officers, under such general rules as the Mayor prescribes.

§ 170.104 QUALIFICATIONS OF AUXILIARY POLICE OFFICERS.

A certified auxiliary police officer shall have the same qualifications as prescribed by law for deputy marshals or peace officers, except that, to retain appointment as auxiliary police officer, such appointee shall afford not less than sixteen (16) hours of service each month in the Village of Rutland subject to the general rules prescribed by the Mayor.

§ 170.105 ESSENTIAL POWERS, DUTIES AND RESPONSIBILITIES OF AUXILIARY POLICE OFFICERS.

(A) Certified auxiliary police officers shall have all powers as may be conferred by law; shall have the power and duty to enforce the laws of the state of Ohio and the ordinances and resolutions of the Village of Rutland within its jurisdiction; shall have the power to make arrests, issue citations, suppress disorder and preserve the peace; and shall have knowledge of and possess and retain a copy of the ordinances of the Village of Rutland. Each auxiliary police officer shall monthly render a report of all arrests made and calls for service and all dates and times dedicated to the Village of Rutland for service, such information shall be transmitted by the Chief of Police to the Mayor and the Council

(B) Non-certified auxiliary police officers shall have those duties prescribed by the Mayor; except that a non-certified auxiliary police officer shall have no power to make arrests. A non-certified auxiliary police officer may assist a certified auxiliary police officer or other certified peace officer in the performance of his or her duties in suppressing disorder and preserving the peace.

§ 170.106 BENEFITS.

Any certified auxiliary police officer duly appointed in accordance with this Ordinance and who has executed the duties and responsibilities as set forth in Section V of this Ordinance shall be entitled to paid education and training, including usage of any police equipment and vehicles owned by the Village of Rutland, subject to approval of the Council.

§ 170.107 REMOVAL OF AUXILIARY POLICE OFFICERS.

The Mayor may, with concurrence of the Council, remove any auxiliary police officer, certified or non-certified, without just cause; and to execute such removal, shall prepare a letter of removal recommendation before the Council who shall concur by simple referendum in favor of to render removal effective.
