§ 170.075 OFFICE OF THE VILLAGE CLERK-FISCAL OFFICER.

In lieu of the elected Office of the Village Clerk, Office of the Village Treasurer and Office of the Village Clerk-Treasurer, the Office of the Village Clerk-Fiscal Officer is hereby established, the head of which shall be the Village Clerk-Fiscal Officer, appointed by the Mayor by and with the advice and consent of the Village Council.

§ 170.076 SALARY OF THE VILLAGE CLERK-FISCAL OFFICER.

The salary of the Village Clerk-Fiscal Officer shall be and is hereby fixed at thirteen dollars and 75/100 hourly. The Mayor shall, by executive order, annually prescribe the hours of service to be fulfilled by the Village Clerk-Fiscal Officer subject to the maximum public funds appropriated for the compensation thereof.

§ 170.077 DUTIES OF THE VILLAGE CLERK-FISCAL OFFICER.

The Village Clerk-Fiscal Officer shall serve as the Clerk of the Village Council and Fiscal Officer of the Municipality. The Village Clerk-Fiscal Officer shall faithfully execute the powers and duties of the Village Clerk and the Village Treasurer as set forth pursuant to the provisions of Title 7 of the Ohio Revised Code, and any other provisions of the Ohio Revised Code prescribing duties and responsibilities to the Village Clerk and Village Treasurer; and any other powers and duties consistent with the nature of the Department of the Village Clerk-Fiscal Officer as may be provided by the ordinances, resolutions and policies of the Municipality.

§ 170.078 VILLAGE TAX ADMINISTRATOR.

The Village Clerk-Fiscal Officer, by virtue of his position, shall be designated as Village Tax Administrator; and, in this capacity, shall receive and disburse all receipts of the municipal income tax; serve as liaison between the Village Council and the Regional Income Tax Agency; report delinquent taxpayer accounts to the Mayor; and provide general assistance with regard to the administration and enforcement of the municipal income tax. The Mayor, in consultation with the Regional Income Tax Agency, shall prescribe duties and responsibilities consistent with those ordinarily prescribed to the Village Tax Administrator.

§ 170.079 RESIDENCY.

Nothing in §§ 170.075 through 170.099 of the Municipal Code shall be construed or require the Village Clerk-Fiscal Officer to be a resident of the Municipality or become the same.

§ 170.080 OHIO FISCAL INTEGRITY ACT TRAINING.

Except as otherwise provided in division (A) through (D) of this section, the Village Clerk-Fiscal Officer shall, not later than one year from the date of appointment, successfully complete six credit hours of initial education courses of Ohio Fiscal Integrity Act training offered by the Office of the Ohio Auditor of State and a minimum of four and one half credit hours of additional continuing education courses of Ohio Fiscal Integrity Act training offered by the Office of the Ohio Auditor of State annually thereafter.

(A) The Village Clerk-Fiscal Officer, having successfully completed public records training from the Office of the Ohio Auditor of State or Office of the Ohio Attorney General may substitute three hours of such training for the credit hours of Ohio Fiscal Integrity Act training as required herein.

(B) The Village Clerk-Fiscal Officer, having successfully completed continuing education hours as a certified public accountant, may substitute the total hours of such training for the credit hours of Ohio Fiscal Integrity Act training as required herein.

(C) The Village Clerk-Fiscal Officer, having successfully completed public investment management training may substitute the total hours of such training for the credit hours of Ohio Fiscal Integrity Act training as required herein.

(D) The Village Clerk-Fiscal Officer, having successfully served as an instructor of a continuing education course approved by the Office of the Ohio Auditor of State may substitute the total hours of such instruction for the credit hours of Ohio Fiscal Integrity Act training as required herein.

§ 170.081 PUBLIC RECORDS TRAINING.

(A) The Village Clerk-Fiscal Officer shall, for himself and on behalf of the public officials and employees of the Municipality, successfully complete three credit hours of public records training, offered by the Office of the Ohio Auditor of State, or Ohio Sunshine Law training, offered by the Office of the Ohio Attorney General, annually.

(B) The Village Clerk-Fiscal Officer shall annually conduct a mandatory public records in-service with public officials and employees of the Municipality annually communicating and instructing the curriculum, standards, policies, procedures and guidelines provided in the public records training or Ohio Sunshine Law training.

§ 170.082 TREASURY; DEPOSITORY.

§ 170.0821 LAW ENFORCEMENT TRUST FUND; ELIGIBLE USES.

(A) There is hereby established in and for the Village the Law Enforcement Trust Fund.

(B) The moneys for said Fund shall come from the proceeds of a public auction of contraband forfeited pursuant to R.C. § 2933.43(C) and sold in the manner prescribed by R.C. § 2933.43(D), after payment of the costs incurred in the forfeiture proceeding, after payment of the balance due on any security interest preserved pursuant to R.C. § 2933.43(C) and after payment of any costs incurred by the seizing agency in connection with the storage, maintenance, security and forfeiture of the property.

(C) The proceeds distributed to any law enforcement fund shall be allocated by the Village Council only to the Village Police Department.

(D) Money deposited into said Fund shall be disbursed and used for any of the following purposes, but for no other purpose:

(1) To pay the costs of investigations or prosecutions;

(2) To provide reasonable technical training or expertise;

(3) To provide matching funds to obtain Federal grants and to aid law enforcement activities;

(4) To provide equipment necessary to the enforcement of criminal laws and ordinances; traffic laws and ordinances as well as drug interdiction and seizure activities and programs;

(5) To pay the costs of emergency action taken under Ohio R.C. 3745.13 relative to the operation of an illegal methamphetamine laboratory if the forfeited property or money involved was that of the person(s) involved in the operation of the laboratory.

(6) Except as otherwise provided in division (E) of this section, to provide funds for such other law enforcement purposes deemed by the Mayor, Village Marshal and Village Council to be appropriate by resolution of the same.

(E) Money deposited into said Fund shall not be disbursed or used for payroll of police personnel, police vehicle fuel, police vehicle maintenance, Village Police Department utilities, or police uniforms or insignia.

§ 170.0822  SAMMY ROBINSON FIELD FUND.

(A) There is hereby established in and for the Municipality the Sammy Robinson Field Fund.

(B) The moneys for said Fund shall come from the fees levied and collected in accordance with § 172.04 and 172.05 of the Municipal Code; and from any fundraising activity for the purpose of benefiting the Fund.

(C) Money deposited into said Fund shall be disbursed and used for any of the following purposes, but for no other purpose:

(1) To provide maintenance of the Sammy Robinson Field for the purpose of keeping the said Field in good repair.

(2) To provide lawn care and maintenance.

(3) To purchase equipment, supplies, materials and uniforms for the conduction of recreational activities, events, sports and other recreational programs at Sammy Robinson Field.

(4) To compensate umpires, provided such umpires are commissioned by the Mayor of the Municipality, by and with the advice and consent of the Village Council.

(5) To pay the costs of utilities incurred through the operation of the Sammy Robinson Field.

(6) To provide matching funds to obtain Federal grants and to aid recreational facilities and programs at Sammy Robinson Field.

§ 170.083 THE VILLAGE RECORD.

(A) There shall be published once monthly, under contract or by the Office of the Village Clerk-Fiscal Officer, a newsletter to be known as The Village Record.

(B) The Village Record shall contain information and record of activities and events, capital and general improvement projects, grant programs and programs and services implemented by the Village of Rutland; public notices as to bills subject to consideration, ordinances and resolutions, public hearings, sale of municipal property and solicitation for materials or services; and, subject to division (C) of this section, communication from Village officers.

(C) Communication from Village officers published in The Village Record shall include—

(1) From the Clerk-Fiscal Officer, a summary of the revenues and expenditures of public funds during the month preceding the month of publication.

(2) From the Code Enforcement Officer, a summary of Municipal Code violations investigated, pending and resolved.

(3) From the Director of Parks and Recreation, a summary of revenues and expenditures of public funds occurring during recreational programs, including recreational facilities and programs participation data.

(4) From the Marshal, a summary of calls for service and complaints, summonses and warrant service.

(5) From the Street Commissioner, a summary of work orders filed and completed.

(6) From the Mayor, a summary of fines, fees and forfeitures in ordinance cases, disbursal of fines, warrants sworn and certificates, licenses and permits issued.

(D) There shall be inserted in The Village Record nothing aside from such official matters as are expressly authorized.

§170.085 ADVERTISEMENT OF PUBLIC NOTICES.

All advertising required of the Village pursuant to applicable law, except as otherwise provided by law, shall be inserted at the public expense in The Village Record and a publication therein shall be sufficient compliance with any law requiring publication of such matters or notices. Nothing herein contained shall prevent the publication elsewhere of any advertisement required by law to be so published.

§170.086 FILING IN THE RECORDS OF THE CLERK FISCAL OFFICER.

The Village Record shall, upon each issue of publication, be filed and retained in the records of the Clerk-Fiscal Officer.

§170.087 ISSUANCE AND PUBLIC AVAILABILITY – RATES.

(A) Except as otherwise provided in division (B) of this section, the Village Record shall be made available by subscription at a rate of two dollars and 00/100 per issue. The Village Record shall be distributed by United States mail to each subscriber.

(B) Any person may obtain a single copy of The Village Record in person at the Office of the Village Clerk-Fiscal Officer without a subscription at a rate of two dollars and 00/100 per issue duplicate.
