§170.150 DEPARTMENT OF CODE ENFORCEMENT; CODE ENFORCEMENT OFFICER.

There is hereby established the Department of Code Enforcement, the head of which, under the Mayor, shall be the Village Code Enforcement Officer, who shall be appointed by the Mayor by and with the advice and consent of the Village Council.


§170.151. CODE ENFORCEMENT OFFICER - POWERS AND DUTIES.

(A) The Village Code Enforcement Officer shall be, for the purposes of §§170.150 through 170.152 of the Municipal Code, a law enforcement officer and a non-certified member of the auxiliary police unit empowered and authorized to enforce the provisions of Title 9; Title 11; Title 15; and Title 17, Chapters 171, 172, 173, 175, and 176 of the Municipal Code, or substantially equivalent municipal ordinance.

(B) In the enforcement of Title 7, Chapter 76; Title 9; Title 11; Title 15; and Title 17, Chapters 171, 172, 173, 175, and 176 of the Municipal Code, or substantially equivalent municipal ordinance, the Village Code Enforcement Officer—

(1) Shall be empowered and authorized to investigate all complaints of any violation of such provisions, and shall be empowered and authorized to forthwith issue and file, upon oath, a complaint of any violation of such provisions with the Mayor’s Court, and a summons to such offender, regardless of the classification of the violation, Provided, however, the Village Code Enforcement Officer shall have no power to arrest without warrant any offender found in violation of any such provisions.

(2) Subject to division (G) of this section, may utilize and operate a public safety vehicle of the Municipality, Provided, however, such vehicle is not utilized for the purpose of traffic enforcement.

(3) May be designated as Constable of the Mayor’s Court, and upon proper qualification, may carry a firearm in the course of his duties as such Constable, and may arrest upon warrant issued by the Mayor’s Court any offender found in violation of Title 7, Chapter 76; Title 9; Title 11; Title 15; and Title 17, Chapters 171, 172, 173, 175, and 176 of the Municipal Code.

(C) Subject to division (G) of this section, upon order or direction of the Mayor, shall be authorized to conduct traffic control within the Municipality, and may operate and use a public safety vehicle of the Municipality.

(D) The Village Code Enforcement Officer, as a member of the auxiliary police unit and subject to rules and regulations promulgated by the Mayor, may assist the Marshal or deputy marshal when summoned by the same, to enforce the laws and ordinances of the state and Municipality, Provided, however, the Village Code Enforcement Officer shall have no power to arrest without warrant any offender found in violation of any such laws or ordinances.

(E) The Village Code Enforcement Officer shall be responsible for the preservation of the health and sanitation of the Municipality, and may assist the Village Street Commissioner in the performance of the duties of the same in the cleaning of municipal parks, parcels, streets, sidewalks, watercourses and other public rights-of-ways and thoroughfares.

(F) The Village Code Enforcement Officer may, if determined as a need by the Mayor in consultation with the Village Street Commissioner, serve from time to time as Village Laborer.

(G) The public safety vehicle authorized for use by the Village Code Enforcement Officer shall be clearly designated as a code enforcement unit, and may be equipped with a flashing blue or a flashing combination blue and white light, or an oscillating or rotating blue light, or a combination blue and white oscillating or rotating light pursuant to R.C. §4513.17(D)(2).


§170.152 PARKING ENFORCEMENT OFFICER.

The Village Code Enforcement Officer is hereby designated as parking enforcement officer, and shall be empowered and authorized to enforce the provisions of Title 7, Chapter 76 of the Municipal Code.


§170.153 SALARY.

The salary of the Village Code Enforcement Officer shall be and is hereby fixed at ten dollars and 00/70 hourly. The Mayor shall, by executive order, annually prescribe the hours of service to be fulfilled by the Village Code Enforcement Officer subject to the maximum public funds appropriated for the compensation thereof.


§170.154 MAYOR TO PRESCRIBE RULES.

The Mayor shall prescribe rules for the organization, training, administration, control, and conduct of the Department of Code Enforcement and its personnel.


§170.155 CODE ENFORCEMENT BY THE STREET COMMISSIONER.

Subject to the general rules prescribed by the Mayor, the Village Street Commissioner shall have the same powers and duties as the Village Code Enforcement Officer, as provided under §170.151 of the Municipal Code, Except, however, the Village Street Commissioner shall not have the power of process service as provided for in §170.151(C) of the Municipal Code.
