Apartment associations in Hyderabad are primarily governed by:
Telangana Apartments (Promotion of Construction and Ownership) Act, 1987 and Rules, 1989
Societies Registration Act, 2001 (for registration of Resident Welfare Associations – RWAs)
Real Estate (Regulation and Development) Act, 2016 (RERA) – for initial formation obligations by the builder
Applicable Municipal and Fire Safety Bylaws (GHMC/HMDA norms)
Manage and maintain common areas & facilities (lifts, corridors, security, water supply, etc.).
Enforce community rules for peaceful co-living.
Represent residents before government authorities and vendors.
Collect and manage maintenance funds and sinking funds.
Ensure legal compliance (property tax, safety audits, building insurance).
A. Ownership Rights
Title & Possession: Full ownership of their flat/unit.
Undivided Share (UDS): Proportionate ownership of land and common areas.
Voting Rights: One vote per apartment (irrespective of size).
B. Usage Rights
4. Access to Common Areas: Lobbies, lifts, parking (as allotted), clubhouse, garden, etc.
5. Participation in Decisions: Attend and vote in General Body Meetings (GBMs).
6. Information Access: View accounts, minutes of meetings, and resolutions.
C. Legal & Protective Rights
7. Redressal: Raise complaints against association decisions if they violate laws/bylaws.
8. RERA Protection: For defects in workmanship within 5 years of possession.
9. Challenge Arbitrary Rules: Rules contrary to the law can be contested legally.
A. Financial
Pay maintenance charges and special levies on time.
Contribute to sinking fund for future repairs.
B. Compliance
3. Follow association bylaws and resolutions.
4. Maintain cleanliness in and around owned premises.
5. Adhere to GHMC/HMDA building safety norms.
C. Community Living
6. Respect neighbours’ privacy & peace (noise limits, pet guidelines).
7. Participate in security, waste segregation, and energy-saving initiatives.
8. Report safety hazards (structural, electrical, fire risks).
Structural Alterations: No changes affecting external façade or structural integrity without association & municipal approval.
Illegal Use: No commercial/industrial activity unless permitted in zoning.
Encroachment: No blocking common areas or parking beyond allotted space.
Nuisance: Loud noise, unsafe storage (flammables), or anti-social behaviour.
Unauthorized Installations: Antennas, signboards, AC units outside designated spots without approval.
Pet Restrictions: Only as per RERA/municipal rules; cannot ban pets outright, but can regulate hygiene & nuisance.
Formation: Builder must form an association within 3 months of majority occupancy.
Registration: Under Societies Registration Act or Co-operative Societies Act.
Office Bearers: President, Secretary, Treasurer elected by members.
Meetings: At least one Annual General Body Meeting (AGM) + periodic special meetings.
Quorum: Usually 1/3rd of members for GBM decisions.
Accounts & Audit: Annual financial statements audited and shared with members.
Amendments: Any bylaw changes require majority approval in GBM.
Before buying, verify:
Registered Apartment Association (check registration number).
Copy of Bylaws / RWA Constitution.
Maintenance charge structure & arrears on the unit.
Approved GHMC/HMDA plan & occupancy certificate.
Insurance coverage for building.
Dispute resolution mechanism in bylaws.
Parking allotment clarity.
