ARTICLE 4
Date of death
1. In issuing a declaration of death, the competent tribunal shall determine the date and the time of death, taking into consideration any evidence or indication regarding Ihe circumstances or the period in which death occurred.
2. In the absence of any such evidence or indication, the date of death shall be fixed at the date of disappearance.
3. The date of disappearance shall be the date of the last known indication of the existence of the missing person. It shall be determined by the tribunal taking into accounts facts brought to its attention and, in particular, the last news of the missing person.
4. In the absence of any evidence or indication regarding the time of death, it shall be declared to have taken place at the last moment of the declared day of death.
ARTÍCULO 4
Fecha del fallecimiento
1. Al expedir una declaración de fallecimiento, el tribunal competente determinará la fecha y la hora del fallecimiento, tomando en consideración cuantas pruebas o indicios existan sobre las circunstancias o la época en que se produjo el fallecimiento.
2. A falta de tales pruebas o indicios, se considerará como fecha del fallecimiento el día de la desaparición.
3. Se considerará como el día de la desaparición la fecha del último indicio conocido de la existencia de la persona desaparecida. El tribunal determinará este día, tomando en consideración los hechos que se hubieren señalado a su conocimiento y, particularmente, las últimas noticias de la persona desaparecida.
4. A falta de prueba o indicación sobre la hora del fallecimiento, se declarará que se produjo en el último momento del día que se hubiere declarado como fecha del fallecimiento.
ARTICLE 5
Effects of declaration of death
I. Declarations of death issued in conformity with the present Convention in one Contracting State shall constitute in the other Contracting State prima facie evidence of death and the date of death until contrary evidence is submitted.
2. However, the Contracting States may by special arrangements, which shall be notified to the Secretary-General, grant broader effects than those provided for in the preceding paragraph to the declarations of death issued in their respective territories.
ARTÍCULO 5
Efectos de las declaraciones de fallecimiento
1. Las declaraciones de fallecimiento expedidas en uno de los Estados Contratantes con arreglo a lo dispuesto en la presente Convención, harán fe en los otros Estados Contratantes respecto al hecho y a la fecha del fallecimiento mientras que no se presente prueba en contrario.
2. Sin embargo, los Estados Contratantes, mediante acuerdos especiales que serán notificados al Secretario General, podrán atribuir a las declaraciones de fallecimiento expedidas en sus respectivos territorios efectos más amplios que los previstos en el párrafo anterior.
Translation Procedure
MODULATION includes also a variation through change of viewpoint, of perspective, and very often of category of thought introducing a clarification with respect to the original formulation. In SL we have "taking into accounts facts brought to its attention". However, in the TL there was a clarification in the orignal translation "tomando en consideración los hechos que se hubieren señalado a su conocimiento"
EQUIVALENCE When the translation uses words completely different to recreate the idea, but this is somehow a commonly used expression. In this occasion the SL has a word very common in legal field "prima facie" which is a Latin expression meaning at first sight or inicial investigation. But, it was translated as "harán fe". In my personal opinion this a different idea from the SL.

Los datos personales deben utilizarse para los fines determinados, explícitos y lícitos para los cuales hubieran sido autorizados al momento de su recolección. Para cualquier otro uso que quiere darse a estos datos personales será necesario obtener el consentimiento del titular, que exista una ley especial que permita dicho tratamiento o que sea necesario para el cumplimiento de una obligación contractual, donde el propietario de los datos sea parte, así como cuando sea requerido por una entidad pública en el ejercicio de sus funciones legales o por orden judicial.

Article 11
Personal data must be used for the specific, explicit and ligal consumption for which they were authorized at the time of collection. In the case of subsequent processing of the data for research, studies or surveys or knowledge of public interest, the consent of the data owner will not be required, provided that the data are anonymized by the person responsible for their custody or processing.
Traslation Procedures
Adaptation is when the SL is modified creatively for its adaptation in TL. In the original text we have the word "lícito", but it's not professional to translated as "lawful". Therefore, I translated as "legal consumption", adpting to a legal translation.
Transposition is When there is a change in the sequence of words. (sequencing shift). In SL "no será necesario el consentimiento del titular de los datos" and the translated version I change the sequence "the consent of the data owner will not be required"
