Pay-As-You-Go Renters Car Roadside Assistance Contract
This Roadside Assistance Agreement (“Agreement”) is entered into by and between BS and I Network Roadside Assistance Services and _____________________________________________, Address ____________________________________________________________________________________________________________________________________________________________Contact:_______________________________________________________________________a Renter Car Individual with its principal place of usage in Portland with outside coverage rates to St. Mary and St. Thomas.

1. Overview of Roadside Assistance Service
BS and I Network Roadside Assistance offers a Pay-As-You-Go Roadside Assistance Service (“Roadside Assistance”) to PERSONS renting vehicles. This service provides assistance in the event of a breakdown, flat tire, lockout, fuel shortage, or other vehicle-related incidents, as outlined below.
By opting into the Roadside Assistance program, the Customer agrees to pay for the service on a per-use basis, as set forth in this Agreement.
2. Services Covered
The following services are covered under this agreement, subject to the availability and limitations of the BS and I Network Roadside Assistance Company's provider network:
Flat Tire Assistance: Replacement of a flat tire with the vehicle’s spare tire (if available). If Spare is not available, the client is responsible for the associated cost to have the vehicle up and running.
Towing: Towing of the rental vehicle to the nearest service facility, or to a location of the Customer's choice. The client will receive a ten (10) percent discount.
Battery Jump-Start: Jump-starting a dead or weak battery. The client is responsible for the technician’s travel time, gas, and mileage.
Fuel Delivery: Delivery of up to 5 gallons of fuel in the event of a fuel shortage (fuel costs are separate and must be paid by the Customer). The client is responsible also for the travel time, gas, and mileage.
Lockout Assistance: Unlocking of the vehicle if the keys are locked inside. The client is responsible also for the travel time, gas, and mileage.
Winching/Off-Road Assistance: This service removes a vehicle stuck in mud or a ditch (limited to areas accessible by a tow truck). The client is eligible for a discounted rate. The client is responsible also for the travel time, gas, and mileage.
3. Costs and Payment Terms
Service Fee: The Customer agrees to pay a fee that includes travel time, mileage, and gas per service request.
Payment: Payment for Roadside Assistance is due at the time of service. The Customer may provide payment via (credit card, debit card), Bank transfer, or any other acceptable method as determined by the BS and I Network Roadside Assistance Service Company.
Additional Charges: The Customer agrees to pay for any additional costs that exceed standard services, including but not limited to the cost of parts, fuel, and any mileage charges for towing that exceed the coverage area.
4. Exclusions and Limitations
Pre-existing Conditions: The Roadside Assistance service does not cover issues that arise from pre-existing damage or defects to the vehicle.
Accidents: Roadside Assistance does not cover any damage resulting from accidents, collisions, or reckless driving.
Non-Operational Vehicles: If the rental vehicle is deemed to be inoperable due to customer negligence or improper usage (such as running out of fuel or off-roading), this service will not apply.
Intentional Damage: Any incident resulting from intentional or malicious damage to the vehicle will not be covered.
5. Service Availability
Roadside Assistance is available 24 hours a day, 7 days a week, but is subject to service provider availability and local area conditions. The BS and I Network Roadside Assistance Service Company does not guarantee service availability at all times.
6. Customer Responsibilities
Notification: The Customer must promptly notify the Rental Company of any breakdown, accident, or incident that may require Roadside Assistance by calling the number provided.
Cooperation: The Customer must cooperate with the service provider, including providing necessary information such as the location of the vehicle, vehicle details, and a description of the issue.
Safe Conditions: The Customer must ensure that the vehicle is in a safe location before requesting assistance. If the vehicle is in a hazardous location (e.g., on a highway shoulder), the Customer should ensure their safety and the safety of any passengers before requesting service.
7. Liability Limitations
The BS and I Network Roadside Assistance Company is not liable for any delays, damages, or costs resulting from circumstances beyond its control, including but not limited to natural disasters, weather conditions, or traffic conditions. The BS and I Network Roadside Assistance Company’s liability for damages arising from Roadside Assistance services is limited to the service fee paid by the Customer.
8. Termination
This Agreement is effective for the duration of the rental period. Either party may terminate the Roadside Assistance services at any time by notifying the other party. Upon termination, any pending charges for services rendered will be due immediately.
9. Indemnification
The Customer agrees to indemnify and hold harmless the BS and I Network Roadside Assistance Company, its employees, agents, and service providers from any claims, losses, or damages arising out of the Customer's use of the Roadside Assistance service, except in cases of gross negligence or willful misconduct by the BS and I Network Roadside Assistance Company and Network Providers..
10. Miscellaneous
Entire Agreement: This Agreement constitutes the entire understanding between the parties with respect to the Roadside Assistance services and supersedes any prior discussions or agreements.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Parish of Portland Jamaica.
Amendments: The BS and I Network Roadside Assistance Company reserves the right to modify or amend the terms of this Agreement at any time by providing notice to the Customer.
11. Acknowledgment and Acceptance
By signing below, the Customer acknowledges that they have read, understood, and agreed to the terms of this Roadside Assistance Agreement.
