# Terms and Conditions for Unlocking Client Vehicles

 Effective Date: November 1st, 2024

 These Terms and Conditions ("Agreement") govern the unlocking services provided by Bs and I Network Roadside Assistance ("Service Provider") to the client ("Client") for the unlocking of their vehicle ("Vehicle"). By utilizing our services, the Client agrees to adhere to these terms and accept any conditions outlined herein.

1. Services Provided

The Service Provider offers professional vehicle unlocking services in case of accidental lockouts. This includes opening the Vehicle without causing damage.

2. Client Responsibilities

- The Client must provide accurate and complete information about the Vehicle, including make, model, year, and location of the lockout.

- The Client represents that they have the legal right to request the unlocking of the Vehicle.

- The Client agrees to provide identification upon request, verifying ownership or authorized use of the Vehicle.

3. Liability and Limitation of Liability

- The Service Provider will take all reasonable precautions to unlock the Vehicle without causing damage. However, in the event of any damage caused during the unlocking process, the Service Provider shall not be liable for damages exceeding the cost of the unlocking service.

- The Client agrees to waive any claims against the Service Provider for damages to the Vehicle that may occur due to the unlocking process, except in instances of gross negligence or willful misconduct.

 4. Payment Terms

- The Client agrees to pay a discounted fee on all applicable fees incurred for the unlocking service prior to or upon completion of the service.

- Prices are subject to change without notice, but the fee quoted at the time of service request will be honored.

- Accepted forms of payment include cash, credit/debit cards, and any other method specified by the Service Provider.

5. Service Availability

- The Service Provider will make reasonable efforts to respond to service requests in a timely manner. However, the timing of service availability is contingent upon factors such as location, traffic conditions, and weather.

- The Service Provider reserves the right to refuse service if safety concerns arise or if there is a risk of damage to the Vehicle.

6. Force Majeure

The Service Provider shall not be liable for any failure to perform its obligations under this Agreement if such failure results from any cause beyond the Service Provider’s reasonable control, including, but not limited to, mechanical failures, natural disasters, war, or governmental actions.

7. Governing Law

This Agreement shall be governed and construed in accordance with the laws of the state of Portland/ Jamaica, without regard to its conflict of law principles.

8. Amendments

The Service Provider reserves the right to amend these Terms and Conditions at any time. Continued use of the service after any changes constitutes acceptance of the new terms.

9. Severability

If any part of these Terms and Conditions is found to be invalid or unenforceable by a court, that part shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

10 Acceptance of Terms

By requesting and utilizing the unlocking services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
