Terms and Conditions for Refueling Client Vehicles
Effective Date: November 1st, 2024
These Terms and Conditions "Agreement" govern the refueling services provided by BS and I Network Roadside Assistance "Service Provider" to the client "Client". By utilizing our services, the Client agrees to adhere to these terms and accept any conditions outlined herein.
1. Services Provided
The Service Provider “BS and I Network Roadside Assistance” “offers fuel delivery and refueling services for vehicles ("Services"), which may include: (5) five gallons of fuel”
- Delivery of requested fuel type (e.g., gasoline, diesel) directly to the Client's vehicle.
- Fueling vehicles in designated safe fueling locations.
2. Client Responsibilities
- The Client must provide accurate information about the Vehicle, including make, model, year, fuel type, and location for refueling.
- The Client must ensure that the Vehicle is accessible and that any obstacles preventing access to the fueling point are removed prior to the scheduled service.
- The Client agrees to have sufficient authorization to request fuel delivery and is responsible for any applicable fueling laws and regulations.
3. Fuel Specifications
- The Client must specify the correct fuel type required for the Vehicle, and the Service Provider “BS and I Network Roadside Assistance” shall not be liable for any damage caused by incorrect fuel being delivered as a result of the Client's error in providing this information.
- The Service Provider will provide fuel that meets industry standards for quality.
4. Liability and Limitation of Liability
- The Service Provider will take all reasonable precautions to ensure safe and effective refueling. However, in the event of any damage to the Vehicle or surrounding property resulting from the refueling process, the Service Provider’s liability shall be limited to the cost of the refueling service.
- The Client agrees to waive any claims against the Service Provider for damages that may occur during the refueling process, except in cases of gross negligence or willful misconduct.
5. Payment Terms
- As a valued member of “BS and I Network Roadside Assistance” program, you are entitled to three service calls each year. Clients determine the services used for all three calls based on the service available. The Client agrees to pay all applicable fees for the refueling service exceeding five gallons prior to or upon completion of the service.
- Fuel prices are subject to change without notice; however, the price quoted at the time-of-service request will be honored.
- Accepted forms of payment include cash, credit/debit cards, and any other payment methods specified by the Service Provider.
6. Service Availability
- The Service Provider “BS and I Network Roadside Assistance” will make reasonable efforts to respond to service requests in a timely manner. However, service availability may be affected by factors such as location, traffic, weather conditions, or high demand.
- The Service Provider reserves the right to refuse service if it is deemed unsafe to perform the fueling or if any legal or regulatory issues arise.
7. Force Majeure
The Service Provider shall not be liable for any failure to perform its obligations under this Agreement if such failure results from any cause beyond the Service Provider’s reasonable control, including, but not limited to, mechanical failures, natural disasters, war, or governmental actions.
8. Governing Law
This Agreement shall be governed and construed in accordance with the laws of the Parrish of Portland/ Jamaica, without regard to its conflict of law principles.
9. Amendments
The Service Provider “BS and I Network Roadside Assistance” reserves the right to amend these Terms and Conditions at any time. Continued use of the service after any changes constitutes acceptance of the new terms.
10. Severability
If any part of these Terms and Conditions is found to be invalid or unenforceable by a court, that part shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
11. Acceptance of Terms
By requesting and utilizing the refueling services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
