Please read these Terms and Conditions ("Terms") carefully before downloading or using Photo Recovery: Phone Cleaner ("Application"), developed and operated by TQC Solution ("we", "us", or "our"). By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Application.
By accessing or using the Application, you confirm that:
You are at least 13 years of age (or the minimum age required in your jurisdiction).
You have the legal capacity to enter into a binding agreement.
You have read, understood, and agree to comply with these Terms and our Privacy Policy, which is incorporated herein by reference.
We reserve the right to update or modify these Terms at any time. Continued use of the Application after any changes constitutes your acceptance of the revised Terms. We will notify users of material changes by updating the "Last updated" date above or through in-app notification.
Photo Recovery: Phone Cleaner is an Android utility application that provides the following features:
Feature -> Processing Location -> Permission Required:
Photos/Videos/Documents Recovery -> On-device (local) -> Storage / All Files Access
Duplicate Photo Detection/ Review Screenshot/ Large Video Analysis -> Server-side -> Storage / All Files Access
Phone Cleaner -> Server-side -> Storage / All Files Access
Features marked as "Server-side" transmit file metadata and/or media data to our secure servers solely to perform the requested operation. Data is deleted from our servers immediately after processing is complete. See our Privacy Policy for full details.
Subject to your compliance with these Terms, TQC Solution grants you a limited, non-exclusive, non-transferable, revocable licence to:
Download and install the Application on Android devices that you own or control.
Use the Application for your personal, non-commercial purposes.
This licence does not include any right to:
Sell, resell, sublicense, or otherwise commercially exploit the Application.
Copy, modify, translate, adapt, or create derivative works of the Application.
Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Application.
Remove, obscure, or alter any proprietary notices, labels, or branding within the Application.
Use the Application in any way that violates applicable local, national, or international law or regulation.
You agree to use the Application only for lawful purposes. You must not use the Application to:
Recover, store, or distribute files that contain unlawful, harmful, defamatory, obscene, or otherwise objectionable content.
Infringe on the intellectual property rights of any third party.
Circumvent or attempt to circumvent any security features of the Application or associated servers.
Interfere with or disrupt the integrity or performance of the Application or any third-party services connected to it.
Certain features of the Application require permissions on your Android device (e.g., Storage Access, All Files Access). You are responsible for understanding the implications of granting these permissions. You may revoke permissions at any time via your device Settings, but doing so may limit or disable certain features.
You are solely responsible for maintaining appropriate backups of your data before using recovery or cleaning features. While our Application is designed to recover lost files and clean unnecessary files safely, we cannot guarantee the recovery of any specific file or that any file will not be affected during a cleaning operation.
The Application may offer premium features through one-time purchases or auto-renewing subscriptions ("Paid Features") processed via the Google Play Store.
All Paid Features are billed through your Google Play account. Prices are displayed in the Application at the time of purchase and may vary by region. By completing a purchase, you authorise the charge to your Google Play payment method.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Google Play account will be charged within 24 hours prior to the end of the current period.
You may cancel a subscription at any time through the Google Play Store (Google Play > Account > Subscriptions). Cancellation takes effect at the end of the current billing period; you will retain access to Paid Features until that date. We do not provide refunds for partial subscription periods except where required by applicable law.
Refund requests are handled in accordance with Google Play's refund policy. To request a refund, please contact Google Play support or email us at developer@tqcsolution.com within 48 hours of purchase.
Where a free trial is offered, it will be clearly disclosed before activation. If you do not cancel before the trial period ends, you will be automatically charged the applicable subscription fee.
All intellectual property rights in and to the Application, including but not limited to its design, code, algorithms, graphics, user interface, logos, trade names, and content, are and shall remain the exclusive property of TQC Solution or its licensors.
Nothing in these Terms transfers any ownership of intellectual property to you. You may not use our trademarks, logos, or branding in any manner without our prior written consent.
Any feedback, suggestions, or ideas you submit to us regarding the Application may be used by TQC Solution freely and without obligation to compensate you.
The Application integrates third-party services including Google AdMob, Google Analytics/Firebase, and Pubstar SDK. Your use of such services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of any third-party service provider.
The Application may display third-party advertisements. We do not endorse and are not responsible for the content, products, or services offered by advertisers. Any interactions with advertisers are solely between you and the advertiser.
The Application may contain links to third-party websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of such sites.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TQC Solution does not warrant that:
The Application will be uninterrupted, error-free, or free from viruses or other harmful components.
Any specific file will be recoverable using the Application.
The Application will be compatible with all Android devices or operating system versions.
Results obtained from using the Application will be accurate or reliable.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TQC SOLUTION, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Loss of data, files, or media content.
Loss of profits or revenue.
Damage to your device or other property.
Any other losses arising from your use of or inability to use the Application.
In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability shall be limited to the maximum extent permitted by law. In all cases, our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $10.00, whichever is greater.
You agree to defend, indemnify, and hold harmless TQC Solution and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Your violation of these Terms.
Your use or misuse of the Application.
Your violation of any third-party rights, including intellectual property or privacy rights.
Any content you transmit through the Application.
Your use of the Application is also governed by our Privacy Policy, available within the Application and on the Google Play Store listing. The Privacy Policy is incorporated into these Terms by reference. By using the Application, you consent to the collection, use, and sharing of information as described in the Privacy Policy.
The Application is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has used the Application or provided us with personal information, please contact us immediately at developer@tqcsolution.com so we can take appropriate action.
These Terms remain in effect until terminated by either party. You may terminate these Terms at any time by uninstalling the Application from your device and ceasing all use.
We reserve the right to suspend or terminate your access to the Application at our sole discretion, without notice, if:
You breach any provision of these Terms.
We are required to do so by law.
We decide to discontinue the Application or any of its features.
Upon termination, all licences granted to you under these Terms will immediately cease. Sections 6 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), and 15 (Governing Law) shall survive termination.
We reserve the right to modify, suspend, or discontinue the Application (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Application or any feature thereof.
We may release updates to the Application from time to time. Depending on the update, you may not be able to continue using the Application until you have downloaded the latest version.
These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good-faith negotiation. If the parties are unable to resolve the dispute within thirty (30) days of written notice, the dispute shall be submitted to the competent courts of Vietnam.
If you are a consumer in the European Economic Area, you may also be entitled to use the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TQC Solution with respect to the Application and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Application.
