Welcome to oioScan! These Terms of Service ("Terms") govern your access to and use of the oioScan mobile application, services, and websites (collectively, the "Service"), provided by ("Company," "we," "us," or "our").
This Agreement constitutes a legally binding contract between you ("User," "you") and the Company, governing your access to and use of the Application.
PLEASE READ THESE TERMS CAREFULLY. BY INSTALLING, REGISTERING FOR, ACCESSING, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE.
1. Acceptance of Terms and Age Requirements
Agreement: This is a legally binding agreement between you and the Company. If you do not agree to these Terms, you must not access or use the Service.
Age Requirements: You must be at least 18 years old to create an account and agree to these Terms on your own behalf. If you are between 16 and 18 years of age, you may only use the Service with the consent and under the supervision of your parent or legal guardian, who agrees to be bound by these Terms. The Service is not intended for children under 16.
2. Intellectual Property Rights
The Application and all related materials, including but not limited to source code, design, text, graphics, logos, and all other intellectual property rights, are the exclusive property of the Company and its licensors. They are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Application or its included software.
3. Intellectual Property and License to Use the App
Company's Ownership: The Service and all materials therein, including, without limitation, software, source code, user interface, design, logos, trademarks, and other intellectual property (the "Company IP"), are owned or licensed by the Company and are protected by copyright, trademark, and other intellectual property laws.
License Grant to You: Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the oioScan application on a device that you own or control, solely for your personal, non-commercial purposes.
4. Prohibited Conduct and Content
You agree to use the Application responsibly and in compliance with all applicable laws. You are strictly prohibited from:
Reverse engineering, decompiling, disassembling, or attempting to discover the source code of the Application.
Using the Application for any illegal, fraudulent, or malicious purpose.
Transmitting viruses, malware, or any other harmful code.
Attempting to disrupt or disable any security features of the Application.
Using the Application in a manner that could damage, disable, overburden, or impair our servers or interfere with any other party's use.
5. Subscriptions, Free Trials, and Payment
Subscriptions: Certain features of the Service may require you to purchase a subscription ("Premium Services"). Subscription fees, terms, and features will be disclosed to you within the application at the time of purchase.
Free Trials: We may offer a free trial period for Premium Services. If you do not cancel at least 24 hours before the end of the free trial, you will be automatically charged the subscription fee for the subsequent period.
Auto-Renewal: All subscriptions are automatically renewable. Your subscription will automatically renew for successive periods of the same duration unless you turn off auto-renewal at least 24 hours before the end of the current subscription period. Deleting the app does not cancel your subscription.
Managing Subscriptions: You are responsible for managing your subscriptions. You can cancel auto-renewal through your account settings in the Apple App Store or Google Play Store.
6. Privacy
Your privacy is critically important to us. Our Privacy Policy explains how we collect, use, store, and protect your personal data. The Privacy Policy is an integral part of these Terms. By using the Service, you consent to the data practices described in our Privacy Policy.
7. Disclaimers
"As Is" DISCLAIMER: THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE COMPANY DOES NOT GUARANTEE THAT THE APPLICATION WILL BE ERROR-FREE, COMPLETELY SECURE, OR THAT IT WILL DETECT AND REMOVE ALL POTENTIAL THREATS. YOU USE THE APPLICATION AT YOUR OWN RISK.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OR INABILITY TO USE THE APPLICATION. IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APPLICATION EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THE USE OF THE APPLICATION IN THE PRECEDING TWELVE (12) MONTHS OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. Drafting this clause carefully is crucial; an attempt to disclaim all liability entirely may be deemed unreasonable and void by courts under consumer protection laws. Therefore, limiting liability to a reasonable amount offers stronger, more enforceable protection.
9. Termination
Termination by You: You may stop using the Service at any time by canceling your subscriptions and uninstalling the application.
Termination by Us: We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any violation of these Terms.
10. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.
Dispute Resolution: Any dispute arising from or in connection with these Terms shall first be resolved through amicable negotiation. If negotiation fails, the dispute shall be submitted to the competent People's Court in [Hanoi, Vietnam] for resolution.
11. General Provisions
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and the Company regarding the Service.
Severability: If any provision of these Terms is found to be illegal, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Changes to Terms: We may modify these Terms from time to time. We will notify you of material changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
