Student Rights and Responsibilities

OFFICIAL UNIVERSITY COMMUNICATION

Upon admission, SJSU students are assigned an email address which serves as an official communication source between SJSU and student. Vital and time sensitive communication messages may include tuition financial aid opportunities, payment and registration deadlines, immunization requirements, and graduation information. Students are responsible for all communications sent to their SJSU email account, as well as their MySJSU account through their single sign-on portal (one.SJS.edu) and should check their emails regularly.

STUDENT CONDUCT AND ACADEMIC INTEGRITY

SJSU is encourages students to reflect on their behavior and its impact on others and the community as a whole both inside and outside the classroom by following the Standards for Student Conduct. Furthermore, the University is committed to maintaining academic integrity. Honesty and responsibility in scholarship is demanded of our students; plagiarism, cheating, and falsifying University documents are unacceptable and subject to disciplinary action. The office of Student Conduct and Ethical Development oversees processes, provides resources, and lists relevant SJSU and CSU policies regarding both student conduct and academic integrity issues.

FAMILY EDUCATION RIGHTS AND PRIVACY ACT (FERPA)

The Family Education Rights and Privacy Act is a federal law that protects the privacy of student records. It gives students certain rights with respect to their education records:

  • the right to view and inspect their records

  • the right to request for an amendment to their records

  • the right to consent to disclosure of personally identifiable information contained in the student’s information records, except to the extent that FERPA authorizes disclosure without consent

San Jose State University does not release information from student records without a written consent from the student, except for student information that the university has deemed as directory information. SJSU Student Information Disclosure policy is more restricted than what FERPA provides as directory information. Requests for contact information are not honored, especially for marketing or membership solicitation purposes. More information regarding FERPA can be found by visiting the Office of the Registrar’s website.

NOTICE OF NONDISCRIMITION AND TITLE IX

Complete information regarding SJSU’s policies, compliance, training, and resources for both Title IX and Equal Opportunity/Affirmative Action issues can be found by visiting the Title IX and Gender Equity Office website. Information on protected status and nondiscrimination can be found in the university catalog. CSU Executive Order 1097 revised August 14, 2020, (or any successor policy) is the systemwide procedure for all complaints of discrimination, harassment or retaliation made by students against the CSU, a CSU employee, other CSU students or a third party. A brief summary regarding the Title IX and Equal Opportunity offices is provided below.

The California State University (CSU) is committed to maintaining an inclusive community that values diversity and fosters tolerance and mutual respect. CSU does not discriminate, and does not tolerate discrimination, on the basis of sex or gender, which includes gender identity (including transgender), gender expression, sexual orientation or sex stereotype in its education programs or activities.

Title IX and Gender Equity Office

Title IX of the Education Amendments of 1972, and certain other federal and state laws, prohibit discrimination on the basis of sex or gender or sexual orientation in employment, as well as in all education programs and activities operated by the University (both on and off campus). The protection against discrimination on the basis of gender or sexual orientation includes sexual harassment, sexual misconduct, and dating and domestic violence and stalking.

Title IX requires SJSU to designate a Title IX Coordinator to monitor and oversee overall Title IX compliance. The Title IX Coordinator is available to explain and discuss the right to file a criminal complaint (for example, in cases of sexual conduct); SJSU’s complaint process, including the investigation process; how confidentiality is handled; available resources, both on and off campus; and other related matters.

Office of Equal Opportunity

The Office of Equal Opportunity Office of Equal Opportunity is responsible for oversight of compliance with non-discrimination, harassment and retaliation based on Age, Disability (physical and mental), Genetic Information, Marital Status, Medical Condition, Nationality, Race or Ethnicity (including color or ancestry, Religion (or Religious Creed), and/or Veteran Status or Military Status, and other characteristics that make our community unique. If you feel you have been subject of discrimination, harassment and/or retaliation, you may file a complaint with the Discrimination, Harassment and Retaliation (DHR) Administrator.
