My WEHOA Resale Certificate contained a number of errors. I had two choices: purchase the home with those errors or void the Agreement of Sale. Because I like the house, I went ahead with the purchase, hoping to get on the Board of Directors at the next Annual Meeting. When I read the attachments, I read that additional board members could be voted in by twos, and I saw that in 2015 two people attempted to run. I was not aware at the time that the current board members use proxy votes to ensure that they and only they will remain the only 3 members of the board of directors. Buyers ought to be aware of this issue prior to purchasing a house.
The following were the errors on my Resale Certificate, numbered to match the items on the certificate:
4) The HOA charged a non-refundable double membership fee (it is improperly called a reserve deposit) for this property while nowhere on the Resale Certificate did it refer to the property as a double lot. In my 12 years experience on the board of directors of the Hampden Heights Homeowners Association, double lots received two bills: one for each lot.
5) The HOA charged me double annual dues, again with no description of a double lot.
6) The HOA stated there was no proposed capital expenditures for the next two succeeding fiscal years, while collecting a hefty membership fee (reserve deposit) and holding over $150,000 in Reserve Accounts.
8) The balance sheet and income statement were dated December 31, 2015. My closing was in October 2016. I should have received a current balance sheet, preferably dated on the date that the resale certificate was printed. If the treasurer is not balancing monthly, this is cause for concern.
11) My resale certificate Certificate indicates there are no existing judgments against the Association, yet fails to mention (as required by the Uniform Planned Community Act) that there is a pending lawsuit. This lawsuit directly affects my property 304 Stone Creek Rd, which is one of 17 lots that I believe has been wrongfully charged double fees for many years.
