Declarant desires to add eighty-one (81) lots in Phase Two, Section 4 of Woods Edge Development to the Declaration (i.e, seventy-six (76) townhouse lots (Lots 1-58 and 61-78) and five (5) open space common area lots), which lots are more fully depicted on the Preliminary/Final Subdivision and Land Development Plan for Woods Edge, Phase Two, Section 4 recorded in the Office of the Recorder of Deeds at Instrument Number 2010-0176-J ("Final PIan"). Lots 59 and 60 depicted upon Final plan are NOT subjected to tbe Declaration. Pursuant to the Final Plan the open space/common area lots will be transferred to and owned and maintained by Wood's Edge Homeowners' Association, Inc. (i.e. Lots 8A, 34A, 50A, 58A and 66A).
Lots 34A and SOA contain streets/access drives that are intended to remain private and not be dedicated to Manor Township (\\Private Streets"). Upon conveyance of Lots 34A and 50A to the Association. the Association shall maintain, repair and replace the Private Streets, in accordance with the Final Plan and the Private Street Agreement with Manor Township recorded in the Office of the Recorder of Deeds for Lancaster County, Pennsylvania at Instrument Number 5893030.
The Private Street within Lot 34A shall be subject to a non-exclusive pedestrian and vehicular access easement in favor of lots 27-42, and the Private Street within Lot 50A shall be subject to a non-exclusive pedestrian and vehicular access easement in favor of Lots 43- S8. Lots 27-58 are hereinafter referred to as the "Private Street Lots". In recognition of the additional costs incurred by the Association to maintain the Private Streets, the owners of the Private Street Lots shall be subject to a separate assessment by the Association to pay for the cost and expense of maintaining and repairing the Private Streets, including snow removal, other winter maintenance, and the establishment of reasonable reserves for the replacement of the Private Streets ("Private Street Assessment"). The Private Street Assessment shall be calculated and imposed in accordance with Paragraph 4.3(a) of the Third Amendment to the Declaration.
