Minutes of the Wilmington Township Planning Commission
Meeting of June 21, 2011
The meeting was convened at 8:00 p.m. at the Township Building.
Members present: William Allen; Frank Antoniazzi, chair; John M. Byler; and Frederick Neikirk, secretary.
Members absent: Lynn Williams.
Visitors: John Galbo; Bert Gerstnecker; Melanie Sumney; Bryce Veon; and Chris Winslow.
1. Secretary’s Report
a. The minutes of the meeting of May 24, 2011, were read. It was moved, seconded, and carried that they be approved as presented.
b. The mylar copy of the drawing for the John E. And Lizzie Y. Wengerd subdivision(s) (see 04/19/11, item 2) was submitted today but there is not a second copy with signatures. Therefore, the officers have not yet signed the plans.
2. John Galbo, Bert Gerstnecker, and Melanie Sumney were present in support of the preliminary plan for a land development for the Animal Medical Clinic which is located on Route 18 (see May 24, 2011, item 3 for background). A letter has been received from the Township Engineer stating that all his concerns have been met. The Commission Secretary asked the Township Secretary to have the Supervisors review the stormwater management agreement to be sure they had no concerns about signing that agreement. No concerns were expressed. A letter has been received from the Sewer Authority stating that they have sufficient capacity for this project. A sewer connection permit has been issued. The Zoning Hearing Board has approved a variance for the setback requirements. The PennDOT Highway Occupancy Permit and the narrative for the plan were submitted at this meeting. The proposal was resubmitted to the County Planning Office, but so far we have no response from them.
It was moved, seconded, and carried that we approve the preliminary plan for the land development proposed by Animal Medical Clinic pending any comments from the County.
It was agreed by common consent that we will hold a special meeting on July 5 at 7:00 p.m. at the Township Building to consider the final plan for the land development for the Animal Medical Clinic provided a) that the applicants agree to bear all costs associated with that meeting; b) that the Solicitor agrees that the final plan does not have to be submitted to the County if there are no material changes from the preliminary plan and c) that we have received the comments from the County or, if we have not, that the applicants can prove that the County has had the plan for at least thirty (30) days and the Solicitor agrees that we can take action once the County has had the plan for thirty (30) days whether or not the County has provided comments on the plan (see MPC 501(b) last sentence). [Note: The Secretary met with the Solicitor the day after the meeting. He agreed that the final plan would not have to be submitted to the County if there were no material changes from the preliminary plan. He also agreed that if the County does not provide comments within thirty (30) days of the date of submission to the County we can act without their comments. However, it turned out that the applicants could not prove that the County received the preliminary plan prior to June 8. That is not thirty (30) days before July 5. Therefore, the applicant agreed to wait until our regular July meeting.]
3. Bryce Veon and Chris Winslow were present in support of the John E. and Elizabeth Y. Wengerd subdivision (a different subdivision than the one noted in item 2). This subdivision would create a new lot of 2.72 acres from lands currently owned by the Wengerds (remaining land is approximately 13 acres) on the south side of Route 208 in an R-3 district. The intent is to use the new land for a medical office building. The lot is served by public water and sanitary sewers. The applicants had received the comments from the County Planning Commission and had revised their plans to meet those comments. However, the Township Planning Commission had not received those comments. It was noted that the drawings lack ground elevations (2303.2.g) and soil types and boundaries (2303.2.n). The applicants asked that the Commission complete Components 3 and 4 of their sewage plan. After working part way through those documents the Commission determined that the Sewer Authority and, perhaps, the Township Engineer, needed to be involved so the Commission declined to proceed further.
It was agreed by common consent that because the Planning Commission does not have the County’s comments (and because thirty (30) days have not elapsed since the plan was submitted to the County) we cannot act on this application at this meeting.
A land development application was filed today for the medical office building being proposed for this property. The Commission noted that before that could be considered the conditional use would have to be approved. In addition, that approval of the conditional use would be necessary for the sewage application.
It was moved, seconded, and carried to add to the call for the special meeting on July 5 the following two items: 1) approval of the John E. and Elizabeth Wengerd Subdivision and 2) review of the conditional use application for the proposed medical office building; provided that all materials for the two applications are submitted by tomorrow and all three conditions noted in item 2, paragraph 3, have been met.
There being no further business that could be accomplished at this meeting, the meeting was adjourned at 9:45 p.m.
