Minutes of the Wilmington Township Planning Commission
Meeting of February 15, 2011
The meeting was convened at 8:04 p.m. at the Township Building.
Members present: William Allen; Frank Antoniazzi, chair; John M. Byler; Frederick Neikirk, secretary; and Lynn Williams.
Members absent: None.
Visitors: Brenda Watson and David Watson.
1. Secretary’s Report
a. The minutes of the meeting of January 18, 2011, had been previously distributed. It was moved, seconded, and carried that they be approved as presented.
b. The Secretary presented a draft Annual Report of the Commission to the Township Supervisors as required by the MPC. It was moved, seconded, and carried that the report be approved with one typographical correction and forwarded to the Supervisors. (Attachment 1)
2. There were no applications for action arising under either the Zoning Ordinance or the Subdivision Ordinance.
3. The Commission took up the proposed amendment to the Zoning Ordinance dealing with “School Bus Storage and Maintenance Facilities” that had been developed by the Secretary in consultation with the Township Solicitor (see 01/18/11, item 4 for background). It was moved, seconded, and carried that the proposed amendment be amended by 800.XX.4 to read “Screening (Section 916) shall be provided on all sides of the use that face a property that, at the time of the approval of the conditional use, contains a residential dwelling that is within three hundred feet (300') of the property line.”
It was moved, seconded, and carried that the proposed amendment be approved and recommended to the Supervisors for their adoption. (Attachment 2)
4. The Commission took up the proposed amendment to the Zoning Ordinance that would create R-3 Residential-Commercial Transition District as a new type of district and make related conforming amendments. The proposed amendment had been prepared by the Secretary in consultation with the Township Solicitor. (See 01/18/11, item 3 for background.) It was moved, seconded, and carried to approve the proposed amendment and recommend it to the Supervisors for their adoption. (Attachment 3)
5. The Secretary shared briefly about items or questions that people had raised with him informally in the last month. He also noted receipt of a copy of the boilerplate Stormwater Management Ordinance with a note that the Township is required to adopt such an ordinance by March 11, 2011. The Township Solicitor does not believe this requires our action or recommendation and the Supervisors have not asked for our recommendation. It was noted, however, that the new regulations will impact our work on subdivisions and land developments. It was agreed that the Secretary should ask the Solicitor if the intent of the ordinance will be that we will act on stormwater plans and waivers as we do with subdivisions and land developments or whether the Supervisors must act on these as they do with sewage issues. If the latter is true it will add steps and time to the approval process for subdivisions and land developments.
There being no further business that could be accomplished at this meeting, the meeting was adjourned at 9:07 p.m.
