The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99), also known as the Buckley Amendment, is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education. When a student reaches the age of 18 or begins attending a postsecondary institution regardless of age, FERPA rights transfer to the student, meaning that it is the student that reserves the right to determine who has access to their FERPA records. Students can submit a written waiver form to release FERPA records to specific individuals by adjusting FERPA settings in Webportal. There are 4 areas that they can give parents/guardians access to: Registrar (grads/classes), Cashier/Bursar (financial), Housing (OHA/REO), and Judicial (CSRR).
FERPA Records, which cannot be disclosed without a waiver:
Grads/academic record (including class schedule)
Conduct records (including incident reports and information of others involved in incident)
Housing information, including room/building assignments
Financial information (payments, outstanding bulls, etc.)
Mail/packages
HR records (refer to HR)
Health records/CPS records/SASC records (HIPAA)
Resident Advisors, Community Assistants, and Desk Assistant/Security Monitors have an obligation to uphold and abide by The Family Educational Rights and Privacy Act. Within REO, this is often encountered at the front desks (in person or over the phone) when parents and/or family members attempt to request information about or contact their students. In order to maintain our students' privacy, we rely on the phrase "I can neither confirm or deny that your student lives in name of residence hall." When appropriate, makes referrals to campus departments if someone is wanting to learn more about specific rights and records:
