Legislation & permissions

When taking images you need to be aware of the following:

  • Permission to take images- When taking photographs in a public place you don't need permission so these can be taken without permission, However taking photographs in a private space requires consent from the person/people in the photograph.
  • Photo release forms- this is a contract between the photographer and the subject or owner of something in a photograph. The release form gives permission, if wanted to publish images of people and property.
  • Copyright permissions- Is the process of getting consent/permission from a copyright owner to use the owner’s material.

Copyright

Photographs and other images are protected by copyright. This means that you will need to get permission from the owner if you want to copy or share the image on the internet. Images include digital photos taken on mobile phones and digital cameras and also diagrams and illustrations.

Licensing

The person who creates an image will be the first owner of the copyright. The creator of the image may chose to license the image which gives someone else permission to use the image.

Creative Commons

The copyright owner of an image can make their work available using Creative Commons (CC) licenses. These licenses allow photos to be re-used without handing over the full copyright.
