Section 504 of the Rehabilitation Act of 1973 is a U.S. federal law that prohibits discrimination against individuals with disabilities in programs and activities receiving federal funding. It mandates equal access and reasonable accommodations.
SB 819 established a new framework under which students with disabilities can receive an abbreviated school day program. Under SB 819, these provisions apply to students with disabilities who are eligible under Section 504 of the Rehabilitation Act of 1973 or under the Individuals with Disabilities Education Act, and to those who are currently being evaluated to determine eligibility. As school leaders, you are invaluable resources regarding the rights of students with disabilities under Section 504 of the Rehabilitation Act of 1973 (Section 504). The U.S. Department of Education’s Office for Civil Rights (OCR) supports your efforts to help our schools comply with Section 504, including the Department’s implementing regulations,. The attached resource guide reminds all educational institutions receiving Federal financial assistance from the Department that they must vigilantly work to ensure compliance with Section 504 and other Federal laws that protect students with disabilities. We intend this resource guide to also help parents of students with disabilities understand the obligations imposed under Section 504. In particular, the resource guide summarizes key requirements of Section 504, and aims to increase understanding of these requirements for both parents and members of the school community alike.
U.S. Department of Education 504 Handbook
The Oregon Department of Education publishes Student Access, a manual which provides information on Section 504 and the ADA. This version of Student Access incorporates the changes to Section 504 and the ADA that resulted from the ADAAA and its implementing regulations. The manual includes guidance on responding to service animal requests in schools, supporting students with the most intense health care needs, and what to do when parents revoke consent for special education and request 504 accommodations instead. Also, the manual includes sections on graduation issues and discipline of students with disabilities under Section 504.
