Bullying

Action must be taken to remedy bullying

If bullying is occurring based on disability there is an obligation to investigation  

• Was it based on disability?

• Was the bullying sufficient to create a hostile environment?

• Is an administrator aware of the issue?

• Did the administrators remedy the situation?

If bullying is occurring and impacting FAPE, then additional obligations

• • Did the school know or should have known it affected FAPE or services?

  • Did the school know about adverse changes (like stopped attending school, drop in grades, etc)?

  • Promptly reconvene team to review plan (IEP or 504)
