Action must be taken to remedy bullying
If bullying is occurring based on disability there is an obligation to investigation
Was it based on disability?
Was the bullying sufficient to create a hostile environment?
Is an administrator aware of the issue?
Did the administrators remedy the situation?
If bullying is occurring and impacting FAPE, then additional obligations
Did the school know or should have known it affected FAPE or services?
Did the school know about adverse changes (like stopped attending school, drop in grades, etc)?
Promptly reconvene team to review plan (IEP or 504)
