If you are charged with a disorderly persons offense, or misdemeanor, involving drugs, such as Simple Possession of marijuana or drug paraphernalia, you may be eligible for a Conditional Discharge, also called Conditional Dismissal (NJ Statute N.J.S.A. 2C:36A-1). This discharge will dismiss the complaint against you as long as you can successfully complete an agreed-upon probation period without being arrested. This probation period can be up to three years, but usually lasts one year.

An expungement is an important step for distancing your self from past criminal charges. Anyone who has ever been either charged, arrested or convicted in the State of New Jersey with a violation of any criminal statute or disorderly persons offense may have difficulty when applying for a new job, obtaining credit, trying to rent an apartment obtaining student loans, applying for college or may simply face embarrassment during the course of any routine background check.

I went through this back in July. I'd been arrested about 10 years ago for posession of under 50g of pot in nj. I got conditional discharge, I put on all of my boa stuff that I have never been convicted of a crime. I had my finger prints done background check came back clean. I'm coming up on my 6 month mark with the company, so I assume everything came back a-ok. I was in a pool with a ton of applicants and I got picked, I would assume if there was anything they didn't like, I wouldn't have gotten the job, so yeah. I hope that helps.

Pre-Trial Intervention (PTI) is available at the Superior Court or County level and deals with a diversion from an indictable criminal offense. If you are eligible (meaning you have little to no prior criminal record and you are not charged with a 1st or 2nd degree crime), you can fill out an application for the program and you will be interviewed by the probation department. They will ask you questions regarding your background, family history, employment, any drug or alcohol issues, etc. The PTI application will then be considered by the PTI review board and you will be accepted or rejected from the program.
