English Multirateral Treaty

ARTICLE I

For the purposes of the present Convention:

1. '"News dispatch" means news material transmitted in writing or by means of telecommunications, in the form customarily employed by information agencies in transmitting such news material, before publication, to newspapers, news periodicals and broadcasting organizations.

2. "Information agency" means a Press, broadcasting, film, television or facsimile organization. public or private, regularly engaged in the collection and dissemination of news material, created and organized under the laws and regulations of the Contracting State in which the central organization is domiciled and which, in each Contracting State where it operates, functions under the laws and regulations of that State.

3. "Correspondent" means a national of a Contracting State or an individual employed by an information agency of a Contracting State, who in either case is regularly engaged in the collection and the reporting of news material, and who when outside his State is identified as a correspondent by a valid passport or by a similar document internationally acceptable.

ARTICLE II

1. Recognizing that the professional responsibility of correspondents and information agencies requires them to report facts without discrimination and in their proper context and thereby to promote respect for human rights and fundamental freedoms, to further international understanding and cooperation and to contribute to the maintenance of international peace and security,

Considering also that, as a matter of professional ethics, all correspondents and information agencies should, in the case of news dispatches transmitted or published by them and which have been demonstrated to be false or distorted, follow the customary practice of transmitting through the same channels, or of publishing, corrections of such dispatches,

The Contracting States agree that in cases where a Contracting State contends that a news dispatch capable of injuring its relations with other States or its national prestige or dignity transmitted from one country to another by correspondents or information agencies of a Contracting or non-contracting State and published or disseminated abroad is false or distorted, it may submit its version of the facts (hereinafter called ''communique") to the Contracting States within whose territories such dispatch has been published or disseminated. A copy of the communiqué shall be forwarded at the same time to the correspondent or information agency concerned to enable that correspondent or information agency to correct the news dispatch in question.

2. A communiqué may be issued only with  respect to news dispatches and must be without comment or expression of opinion. It should not be longer than is necessary to correct the alleged inaccuracy or distortion and must be accompanied by a verbatim text of the dispatch as published or disseminated, and by evidence that the dispatch has been transmitted from abroad by a correspondent or an information agency. 

ARTÍCULO I

A los fines del presente Convenio:

1. Por "despacho de noticias" se entenderá el material informativo transmitido por escrito o por medios de telecomunicación, en la forma habitualmente empleada por las agencias de información para transmitir dicho material informativo, antes de su publicación, a diarios, publicaciones periódicas y organismos de radiodifusión.

2. "Agencia de información" significa una organización de Prensa, radiodifusión, cinematografía, televisión o fax. pública o privada, dedicada regularmente a la recopilación y difusión de material de noticias, creada y organizada conforme a las leyes y reglamentos del Estado Contratante en el que la organización central esté domiciliada y que, en cada Estado Contratante en el que opere, funcione conforme a las leyes y reglamentos de dicho Estado.

3. "Corresponsal" significa un nacional de un Estado Contratante o una persona empleada por una agencia de información de un Estado Contratante, que en ambos casos se dedica regularmente a la recopilación y difusión de material informativo, y que cuando se encuentra fuera de su Estado está identificado como corresponsal por un pasaporte válido o por un documento similar internacionalmente aceptable.

ARTÍCULO II

1. Reconociendo que la responsabilidad profesional de los corresponsales y de las agencias de información les obliga a informar sobre los hechos sin discriminación y en su debido contexto, y a promover así el respeto de los derechos humanos y de las libertades fundamentales, a favorecer la comprensión y la cooperación internacionales y a contribuir al mantenimiento de la paz y la seguridad internacionales,

Considerando también que, por ética profesional, todos los corresponsales y agencias de información deben, en el caso de despachos de noticias transmitidos o publicados por ellos y cuya falsedad o tergiversación haya sido demostrada, seguir la práctica habitual de transmitir por los mismos canales, o de publicar, correcciones de dichos despachos,

Los Estados Contratantes convienen en que, cuando un Estado Contratante sostenga que un despacho de noticias capaz de perjudicar sus relaciones con otros Estados o su prestigio o dignidad nacionales, transmitido de un país a otro por corresponsales o agencias de información de un Estado Contratante o no Contratante y publicado o difundido en el extranjero, es falso o está tergiversado, podrá presentar su versión de los hechos (en lo sucesivo denominada ''comunicado'') a los Estados Contratantes en cuyos territorios se haya publicado o difundido dicho despacho. Al mismo tiempo, se remitirá una copia del comunicado al corresponsal o a la agencia de información afectados para que éstos puedan rectificar el envío de noticias en cuestión.

2. Un comunicado sólo podrá emitirse con respecto a despachos de noticias y deberá ser sin comentario ni expresión de opinión. No deberá ser más largo de lo necesario para corregir la supuesta inexactitud o distorsión y deberá ir acompañado de un texto verídico del despacho tal como fue publicado o difundido, y de la prueba de que el despacho ha sido transmitido desde el extranjero por un corresponsal o una agencia de información.
