What is a DMMO?
A DMMO is a Definitive Map Modification Order. This is an application to have the Definitive Map altered to either add, delete or upgrade a Right of Way.
Why is it Important?
The Definitive Map is the only record of Rights of Way and as such protects them in law. The Council is responsible for ensuring the Rights of Way remain open and accessible by either ensuring Landowners keep up there responsibilities or by undertaking action themselves.
Historical or User Evidence?
Applications of a DMMO must provide either
historical evidence that the route was historically a right of way (the evidence being gathered via research)
user evidence to demonstrate that the route has been used, unhindered, unchallenged and without permission having been granted, for a period of 20+ years
3 DMMO's submitted in February 2024
We have submitted 3 DMMO's to Rochdale's Rights of Way Officer in the Heywood and Crimble Area. BUT we could do with some more user evidence to strengthen the applications. If you have ever ridden one or more of the following three routes please can you contact us (nbhbridleways@gmail.com) so we can arrange for an evidence form to be filled in. The routes are
End of HeyBP59, outside Heywood Cricket Club to Shadwell Street West and then Queens Park Road. This route joins up HeyBP59 with both HeyBP56 at Mine Street and HeyBP54 at Hooley Bridge, with minimal road work between the Bridlepaths, allowing access then to Ashworth Valley.
End of HeyBP59, outside Heywood Cricket Club to Mutual Street. This route joins up Hey BP59 with HeyBP65 allowing circular route around the fields towards Castleton. With the proposed development on Crimble Fields it is important that this route is recognised before access to any new housing developments are decided.
Around Crimble field following the route of HeyBP59. This route is only being claimed so that Riders are afforded safe riding from Heywood Cricket Club right the way round to Captains Fold and hence to Rochdale Road East. The existing Bridlepath HeyBP59 from Crimble Mill to Rochdale Road East (a single lane with passing places) is being proposed to be the access route for over 150 Houses proposed for development on the Crimble Mill Site. NBHBA attended the planning application for the development and proposed a diversion of the Bridlepath from this road onto the endge of the field which has been ridden by many until the fence was reinstated in March 2020 stopping access to the field. The developers showed no interest in making the existing bridlepath safe for its users and so for this reason and this reason alone a DMMO has been applied for covering the whole of the field edge which has been used by many up to March 2020.
