Terms & Conditions
The JacksStats mobile applications, related websites and services (collectively, the “Services”) are made available to you by Martin Ryan. By downloading or using these Services, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the Services. You’re not allowed to copy or modify the Services, any part of the Services, or my trademarks in any way. You’re not allowed to attempt to extract the source code of the Services, and you also shouldn’t try to translate the Services into other languages or make derivative versions. The Services, and all the trademarks, copyright, database rights, and other intellectual property rights related to it belong to Martin Ryan.
Martin Ryan is committed to ensuring that the Services are as useful and efficient as possible. For that reason, he reserves the right to make changes to the Services or to charge for Services, at any time and for any reason. He will never charge you for Services without making it very clear to you exactly what you’re paying for.
The Services store and process personal data that you have provided to me. It’s your responsibility to keep your device and access to the Services secure. Martin Ryan therefore recommends that you do not jailbreak or root your device, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your device vulnerable to malware/viruses/malicious programs, compromise your device’s security features and it could mean that the Services won’t work as intended.

You should be aware that there are certain things that Martin Ryan will not take responsibility for. Certain functions of the mobile application will require the Services to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Martin Ryan cannot take responsibility for the Services not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the Services outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the Services, or other third-party charges. In using the Services, you’re accepting responsibility for any such charges, including roaming data charges if you use the Services outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the Services, please be aware that Martin Ryan assumes that you have received permission from the bill payer for using the Services.
Martin Ryan cannot always take responsibility for the way you use the Services e.g. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Services, Martin Ryan cannot accept responsibility.
With respect to Martin Ryan’s responsibility for your use of the Services, when you’re using the Services, it’s important to bear in mind that although he will endeavour to ensure that it is updated and correct at all times, the Services do rely on third parties to provide information and functions that is made available to you. Martin Ryan accepts no liability for any loss, direct or indirect, you experience as a result of relying on the functionality of the Services.
At some point, Martin Ryan may wish to update the Services. The mobile application is currently available on iOS and Android – the requirements for the system (and for any additional systems I decide to extend the availability of the mobile application to) may change, and you’ll need to download the updates if you want to keep using the mobile application. Martin Ryan does not promise that he will always update the mobile application so that it is relevant to you and/or works with the iOS or Android version that you have installed on your device. However, you promise to always accept updates to the mobile application when offered to you, Martin Ryan may also wish to stop providing the Services, and may terminate use of it at any time without giving notice of termination to you. Unless Martin Ryan tells you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the Services, and (if needed) delete it from your device.
Payments
To pay any fee, you must designate and provide information about your preferred payment method (e.g., credit card, online payment service, a third party, like iTunes or Google Play, or any other payment method made available by Martin Ryan) (the “Payment Method”). If you provide your payment information, you authorize the third party service providers, payment card networks and payment processors to receive, store and encrypt your payment information. If you paid through the Google Play or iTunes store, you may change your Payment Method through the corresponding store account. No refunds or credits will be provided by me, other than as set forth in these Terms. If your payment provider determines that there are fraudulent charges on your account resulting from use of your Payment Method at the Services, please contact me immediately via the email address at the foot of this page.
Fees
In order to access certain functionality of the Services, you may be required to pay subscription fees. Subscription fees, along with any required taxes, may be paid on a quarterly basis. All subscription fees are payable in advance. You agree to pay the subscription fees, and other charges you incur in connection with your JacksStats account, whether on a one-time or subscription basis. I reserve the right to increase subscription fees, any associated taxes, or to institute new fees at any time upon reasonable advance notice.
Auto-Renewal
Subscription fees will be billed automatically at the start of the quarterly period, as applicable. These fees will auto-renew until your subscription is downgraded or terminated. Your subscription fee will be the same as your initial charges unless you are otherwise notified in advance. You may cancel your subscription at any time, as described below.
Cancellation of Subscription
If you signed up through the Google Play or iTunes store, you may cancel your subscription by downgrading through the corresponding store. The cancellation of a subscription will go into effect at the end of your current billing cycle. When your subscription ends, your account will remain and become a free subscription. You can renew your subscription at any time without opening a new account, although the subscription fees may have increased. You can delete your account at any time.
Changes to This Terms and Conditions
Martin Ryan may update these Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. He will notify you of any changes by posting the new Terms and Conditions on this page.
