About these terms
These Terms govern your use of ProMedia and its related services. ProMedia is operated by Brainify SMC Limited. “We,” “us,” and “our” refer to Brainify SMC Limited.
By using ProMedia, you agree to these Terms. If you do not agree, do not use the app. Nothing in these Terms removes rights that applicable law does not allow us to exclude.
Eligibility
You must be at least thirteen years old, or the higher minimum age required by applicable law, to use ProMedia. If you are below the age of legal adulthood, a parent or legal guardian must authorize your use and purchases where required.
Hosted AI features are available only to adults aged eighteen or older, subject to applicable provider and regional restrictions. Parental permission does not override a provider’s minimum-age requirement.
You must also comply with the applicable store and platform terms.
What ProMedia provides
ProMedia provides tools for processing video, audio, images, and subtitles. Features may include editing, conversion, compression, batch processing, reusable workflows, transcription, captions, narration, translation, and AI-assisted suggestions.
Core media processing runs on your device. Optional hosted AI sends the disclosed text and related information to external services after you authorize that processing.
Availability depends on your device, operating system, language, installed models, entitlement, region, connectivity, and service availability. Features may differ between platforms. Processing times, output sizes, and compatibility estimates are not guarantees.
Your content
You retain the rights you already hold in your files, instructions, and other content. Using ProMedia does not transfer ownership of that content to us.
You authorize us and the providers involved in your chosen features to process your content as necessary to perform your requests, provide support you request, and carry out the processing described in the Privacy Policy.
You are responsible for having the rights and permissions needed to import, download, edit, reproduce, translate, and share content; process recordings, images, voices, and information relating to others; submit content to an external AI service; and use third-party music, fonts, images, and other materials.
Possessing a file or public link does not necessarily authorize every use of the content.
Files, exports, and backups
Keep appropriate backups of important source files and review finished outputs.
Processing can change quality, metadata, timing, dimensions, and compatibility. Some actions may overwrite, replace, rename, or delete files when you choose the relevant option.
Deleting history may leave output files intact. Deleting an output does not necessarily remove its history or copies stored elsewhere.
ProMedia is not a backup service. Storage shortages, interruptions, unsupported formats, operating-system restrictions, and software failures can prevent successful processing. These provisions do not limit remedies you may have under mandatory consumer law.
AI and automated results
AI-generated text, transcripts, captions, translations, edit plans, clip suggestions, chapter names, and synthetic narration may be inaccurate, incomplete, unsuitable, or similar to material produced for others.
Review results before relying on, applying, publishing, or distributing them. Check transcription, translation, timing accuracy, suggested edits, cuts, and workflow settings. Check whether blur, redaction, or metadata removal achieves your intended result. Obtain any rights or permissions and provide any disclosures required for synthetic or altered media.
We do not guarantee that generated material is unique, copyrightable, free of third-party rights, or suitable for a particular purpose. We do not claim ownership of your output merely because you used ProMedia.
Hosted AI requires available service capacity, a supported connection, the applicable entitlement, and permission to send the disclosed information. Access to AI tools does not mean unlimited hosted AI processing. Daily or other limits may apply as described in the app.
Free features and advertisements
The free version may include advertisements and restrictions on features or processing allowances.
Where offered, rewarded advertisements provide the benefit described in the app. Availability of advertisements or rewards is not guaranteed.
Pro benefits are described before purchase and may differ by platform. Unlocking a feature does not remove hardware or operating-system limitations.
Purchases and subscriptions
Products, prices, billing periods, trial conditions, and included benefits are displayed before purchase. Review the store’s purchase confirmation before completing payment. Payments are processed by the relevant app store. RevenueCat assists with purchase verification and access management.
Subscriptions renew automatically unless canceled through the relevant store before its applicable renewal deadline. For Apple subscriptions or trials, cancel at least twenty-four hours before the current period ends where required by Apple’s terms. For Google Play, cancel before the next renewal using the timing and controls provided by Google Play.
Deleting the app, clearing app data, or stopping use does not cancel a subscription. Cancellation normally stops future renewals while access continues until the end of the paid period, subject to store terms and applicable law. Trial access may end differently.
Trials and introductory prices apply only when expressly offered and when you meet the store’s eligibility requirements. Unless canceled in time, the offer may convert to the paid subscription shown at checkout.
If offered, a lifetime purchase is a one-time payment for the Pro entitlement described at purchase. It does not automatically renew. It does not automatically include separately sold products or unlimited third-party AI processing unless expressly included in the purchase offer. We will not use these Terms to remove benefits expressly promised when you purchased.
Use “Restore purchases,” where available, with the appropriate store account to restore eligible access. Purchases are not guaranteed to transfer between different platforms or stores unless expressly supported.
Refund requests for store purchases are generally handled through the relevant store’s refund process. Contact us if you need help finding the appropriate route. Nothing in these Terms excludes refund, withdrawal, or other remedies required by law.
Acceptable use
You must not use ProMedia to infringe intellectual-property, privacy, publicity, or other legal rights; create or distribute unlawful material, child sexual abuse material, non-consensual intimate imagery, or harmful deceptive impersonations; obtain or distribute media without the necessary authorization; or unlawfully bypass DRM, access restrictions, or copy protection.
You must not attack, disrupt, or gain unauthorized access to the app or connected services; manipulate purchase verification; impersonate another user; fraudulently evade service limits; or bypass applicable AI safety restrictions.
Restrictions on reverse engineering, modification, or redistribution apply only to the extent permitted by law and do not override rights granted by applicable open-source licenses.
Third-party services
ProMedia may interact with app stores, cloud file providers, model publishers, advertising services, system speech services, and AI providers.
Their separate terms and privacy practices apply to their services. We remain responsible for our own obligations to you.
A supported import or export option does not imply affiliation with a third-party platform or permission to download its content. Third-party outages, policy changes, model discontinuations, and compatibility changes may affect connected features.
Software ownership and open-source licenses
ProMedia’s proprietary software, design, branding, and related materials belong to Brainify SMC Limited or its licensors. We grant you a limited, non-exclusive license to use ProMedia in accordance with these Terms and applicable store rules.
ProMedia includes third-party and open-source components. Their licenses and notices govern those components and take precedence over conflicting restrictions in these Terms. License information is available within the app where provided.
Updates and changes to services
We may update or change features to improve the app, address security issues, maintain compatibility, or respond to legal and provider requirements. Connected features may require a minimum app version.
We will communicate material changes to paid services or pricing as required by law and applicable store rules. Changes will not retrospectively remove benefits or rights that we are legally required to honor.
Any right to cancellation, a refund, or another remedy arising from a material change or discontinuation remains unaffected.
Suspension and termination
We may restrict access to connected services when reasonably necessary to address a material breach of these Terms, fraud, security threats, or legal requirements. Where appropriate and legally permitted, we will provide notice and an opportunity to resolve the issue.
You may stop using ProMedia at any time. Cancel active subscriptions separately through the relevant store to stop renewal charges. Suspension or termination does not remove remedies required by law.
Warranties and liability
We aim to provide a reliable app but cannot guarantee uninterrupted operation, compatibility with every file or device, perfect AI results, or a particular processing speed.
To the extent permitted by law, ProMedia is provided on an “as available” basis. We exclude warranties that are neither expressly stated nor legally required. To the extent permitted by law, we are not responsible for indirect or consequential losses arising from use of the app.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, deliberate misconduct, or applicable mandatory consumer guarantees. Your statutory rights concerning faulty digital content or services remain unaffected.
Privacy
Our Privacy Policy explains how ProMedia handles files, identifiers, purchases, advertising, diagnostics, optional hosted AI, and privacy requests.
Accepting these Terms does not replace any separate permission required for hosted AI or other consent-based processing.
Governing law and disputes
These Terms are governed by the applicable laws of Pakistan, subject to mandatory consumer protections and other rights that apply in your country of residence.
Nothing in these Terms prevents you from using a competent court, regulator, or dispute-resolution process available to you under applicable law. Please contact us first if you have a problem so we can try to resolve it.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
Changes to these terms
We may update these Terms and will display the revised date above. We will provide additional notice or obtain agreement where required. Material changes apply prospectively, subject to applicable law and rights attached to existing purchases.
