Because state background checks revealed an increasing number of licensure applicants with criminal records, the Kansas Board of Nursing (BON) instructed its staff to research the problem. In 2005, the BON voted to introduce legislation requiring a background check for nurse licensure. At the same time, the BON was challenged to determine the best process for screening applicants. In 2008, the Kansas legislature passed a bill implementing a criminal background history and Federal Bureau of Investigation screening for all initial applicants for nursing and mental health technicians. At the same time, the board made the decision that this background check would be implemented using live scan fingerprint technology.

The objective of our evaluation was to determine whether all Military Services Law Enforcement Organizations (LEOs) had submitted fingerprint cards and final disposition reports for Military Service members convicted by court-martial of qualifying offenses, as required by DoD instruction. In 1999, the Nurse Practice Act changed to require state & federal criminal background checks of CNAs and licensed nurses. Arizona currently provides oversight to one skill level of Nursing Assistant - approximately 28,000 Certified Nursing Assistants (CNA’s).

The Office of Inspector General's investigation found that an agency employee tasked with logging into an FBI crime database during the applicant vetting process stopped logging in in February 2016. She told investigators she did not follow up to resolve the issue, and her failure to check the database went unnoticed until March 2017. The FBI database is considered a "vital component" in the applicant review process that ensures those with disqualifying histories in other states — that include criminal convictions or a mental illness diagnosis — don't get concealed gun permits.
