COURSE DESCRIPTION
This course explores the nature, structure, and legal power of Canadian municipalities and their relationship to provincial government with emphasis on land use planning and regulation. The course covers the following topics:
the nature of municipalities
the scope of municipal powers
the local council, mayor, and local elections
municipal finances
planning and zoning
provincial planning and regulation
development approval, development appeals, and judicial review
municipal-Indigenous relationships
climate change, adaptation and resilience
municipal liability
The primary materials used in the course are the Municipal Government Act of Alberta, planning instruments (especially statutory plans and land use bylaws) of the City of Edmonton, and other urban and rural municipalities, and selected case law and secondary sources. Some class time will be devoted to drafting exercises.
