70% Case Comment and 30% Class Participation
COURSE DESCRIPTION
We will explore contemporary doctrinal issues through cases. Topics will include contract interpretation and good faith performance, and may include formation, drafting, agency, consumer law, boiler plate and digital contracting, unconscionability, and mistake. Generally, we will read and discuss one to two cases per class, though we will read some scholarship as well. Assessment will be primarily based on fact-pattern analysis demonstrating command of the law studied, but you will be asked to bolster your argument where appropriate with the studied scholarship.
