ABC Eye Center in West X Offers Free Vision Screening, Press Release by Poppy Johnson
Dr. Patrick F. A. and Dr. Duane F. A. of The ABC Eye Care Center, are offering free vision screening to children without insurance in an effort to provide early diagnosis and preventive screenings for school-aged children. Children who experience eye problems are often unaware of the seriousness of the problem until it is too late to provide corrective action. Many children at young ages are unable to articulate that they are experiencing differences with their vision, and in this case the parents often have no idea that their child’s eyes are at risk for disease.
Dr. Patrick F. A. offers free vision screenings for area school-aged children to avoid problems and issues with their vision from becoming major problems later on. When children are given general vision screenings by the nurse at their school, there are many vision problems that are missed by this routine and broad examination. Although these general screenings provide a beneficial service to area children, they typically detect only 5% of vision problems at the time of the examination. “When vision problems are detected early,” says Dr. A., “appropriate therapy can be implemented immediately and learning and self esteem problems due to poor vision can be completely avoided.”
One West X family in particular warms Dr. A.’s heart in this regard. The mother of the family had just experienced a layoff from her employment, and the father ran his own successful business locally. Is it just me or are sit-ups a waste of time? by Graeme Hilditch

Title: 150 common diet and exercise myths debunked.
Finally, a book that puts to rest the major myths about working out and offers real guidance on what we should all be doing to live healthier and more physically active lives. Graeme Hilditch is a top personal trainer in the UK who effortlessly debunks what we all think we know about the dos and don’ts of exercising. He turns us all into experts by the end of the book. And no, sit-ups are not as beneficial as most of us have been taught, and may be at the least a waste of time for anyone interested in developing abdomen muscles (he does offer alternatives that work better in the short and long run for obtaining that elusive six-pack).
The book offers advice on better exercise routines for maximum results, and highlights the answers to the most popular questions regarding working out, losing weight, maintaining or developing muscle mass, starting a workout regimen and gives helpful nutritional advice to readers.
The book includes cartoons, charts, graphs, bullet points and a question and answer format to explain what people should be doing to achieve their fitness goals. The author speaks from experience, personal knowledge and common sense, and is able to tell the reader the truth regarding all aspects of exercise routines and food diets. Ever topic is covered, with sections such as: hyperventilation during sporting events to increase breathing as a sport participant (beneficial or not), the Adkins Diet, how women can reduce fat on hips and legs by avoiding specific foods, whether beer gives you a “beer belly,” using probiotic drinks and yogurts for alleviating digestive problems works, information on amino-acids and vitamin supplementation, the division of injuries between men and women, and whether dandelion root supplements help you lose weight or not. Aside from the British spelling of words and phrases (“yoghurt” for yogurt), the book is on point with no distractions for the American audience. The advice is good, no really great, and the book is highly recommended for everyone who works out or who wants to start a workout program of every age.

Abstract
Consumers have had difficulties with the DVD-RW/+RW systems that thwart the rewriter market of DVDs. The +RW and –RW drives can easily play DVD-videos on their systems, but the players of Blu-ray and HD DVD players will only work with movies which have been originally recorded in their operating system formats. The red-laser DVDs today hold 8.5GB of content, while blue-laser discs can save tens of gigabytes into the same disc area CD-ROMs and DVD drives can use automatic ball balancers fitted on a spindle motor of optical disc drives with optical disc use, but should have an operating speed higher than the translational natural frequency of the system being balanced. The nature of red GaInP – AlGaInP epitaxial wafer laser diodes allow them to have many useful applications, and are low cost and compact as well. The temperature distribution of in-land groove phase-change optical disks, the temperature profiles appear to be different between the land track and the groove track, with the thermal cross-track higher than from the groove track to its neighboring land tracks. Scientists note that the next generation of optical disc units will utilize high numerical aperture (NA) objective lens and discs, which will also include multiple data-layers to compensate spherical aberrations (SA).
The development of DVDs in the 1990s was a slow process, with companies fighting over revenues and royalties within the industry. The Blu-ray and HD DVDs are of split teams – each system has a separate set of patented technologies behind it, and each is continuing to be updated with even more promising technology. But the consumers are at the losing end of the game, since the systems are seldom compatible. For this reason, consumers either have one system or the other, rarely both, which makes the systems in direct competition with each other.
Consumers have had difficulties with the DVD-RW/+RW systems that thwart the rewriter market of DVDs. The +RW and –RW drives can easily play DVD-videos on their systems, but the players of Blu-ray and HD DVD players will only work with movies which have been originally recorded in their operating system formats. Another necessity was that the Content Scrambling Systems be replaced by the more secure AACS (Advanced Access Content System) which each operating platform has to use to satisfy Hollywood’s insistence on blocking movie piracy among consumers. The AACS system is “a flexible digital rights management system that allows functions….to revoke the rights of cracked devices to play copy-protected discs” (Labriola, 2006, p.80). The Blu-ray developers also added the BD+ component (shifting some of the cryptographic algorithm to the disc itself) and adding a watermarking system called BD Mark to prevent piracy at all levels.
Toshiba was the first company to make a blue-laser DVD player, but other companies have become such close rivals that it does not matter that Toshiba was first in this area. The Toshiba company lowered the price below cost to capture the consumer market who would watch movies at home as opposed to going to the movie theatre to watch a show.
The old HD DVDs were re-mastered from outdated and poor audio source materials, which resulted in high-resolution discs which were typically grainy and difficult to enjoy watching as consumers (Labriola, 2006, p. 83). The reason for the poor quality was because the H.264/AVC codecs were not available, forcing the early DVDs to use VC-1 codec to compress their content. They also lacked advanced functionality in the early days of HD DVD systems. Today, there are superior HD DVD XML-based iHd or Bue-ray’s Java-based BD-J authoring tools available (Labriola, 2006, p. 83). The Blu-ray and HD DVD operating systems will improve as the developers of these systems begin to be familiar with iHD and BD-J technology tools to compress audio and video onto optical discs (Labriola, 2006, p. 83).
Blu-ray and HD DVD discs have not met the expectations of the public regarding what the technology can do to enhance viewing media in the home or away from the home. Although some reviewers find the early players offering less than stellar performances, the blue lasers are considered a “work in progress” and they are capable of much more. The red-laser DVDs today hold 8.5GB of content, while blue-laser discs can save tens of gigabytes into the same disc area (much like a HD movie) (Labriola, 2006, p. 77).
In the case of automatic ball balancers, the performance of an automatic ball balancer which is fitted on a spindle motor of optical disc drives (with CD-ROMs or DVD drives) should have an operating speed higher than the translational natural frequency of the system to be balanced (Kim, 2002, p. 1071). If there is a problem with the stability (stiffness and damping of rubber suspensions) the automatic ball balancer’s performance should be evaluated for the variation of operating speed of the unit. The result should be that the natural frequency of the translational and rotational motion will be influenced by the balancing performance of the automatic ball balancers (Kim, 2002, p. 1071).
All optical disc drives use lasers to read and write data onto their discs. They are an inexpensive way to hold 650MB to 800MB of data if using a CD, and a DVD holds upwards of 4.7 GB (with a dual layer DVD holding up to 8.5GB) (“Optical Storage,” 2009, p. 60). For drives offering dual layers of support, the new optical burners can be compatible with all formats. There are some optical discs on the market which are faster than others. The drives with the fast write speeds will allow the consumer to upload and store the information quickly. For example, 32X and the fastest, 52X CD-R have a write speed at one minute, the speed of larger-capacity DVD±R and DVD±R DL media is more significant. It takes 15 minutes to burn a full DVD±R with a 4X write-speed drive, with 8 minutes with an 8x writer, and under 3 minutes with the fastest 22x writer. For DVD±R DL discs, many drives offer the consumer 8x write speeds (“Optical Storage,” 2009, p. 60). It is important to check the driver’s speed time before using it.
The low cost and compact portable nature of red GaInP – AlGaInP epitaxial wafer laser diodes allow them to have many useful applications (Elliott, Smowton & Berry, 2006, p. 321). These systems support the most popular read/write DVD optical storage systems and are commonly used with polymer optical fibre with a transmission window at 650 nm in the middle of the red range, and uses lasers or resonant cavity light emitting diodes, which are suitable for data networks (Elliott, Smowton & Berry, 2006, p. 321).
There are problems with optical disc technology. For example, when reviewing the temperature distribution of in-land groove phase-change optical disks, the temperature profiles appear to be different between the land track and the groove track, with the thermal cross-track higher than from the groove track to its neighboring land tracks (Peng & Mansuripur, 2000, p. 1214). The calculations in various experiments demonstrate that the temperature distribution depends on “the wavelength of light, the state of polarization and the geometry of the groove structure” (Peng & Mansuripur, 2000, p. 1214).
Scientists note that the next generation of optical disc units will utilize high numerical aperture (NA) objective lens and discs, which will also include multiple data-layers to compensate spherical aberrations (SA) (Knittel, et al, 2005, p. 15). It is known that the SA will occur when the cover-layer thickness deviates from the nominal value, such as in a blu-ray disc (BD) system which requires SA compensation to account for these variations. One way to compensate for the SA is to adjust the position of the oolimator lens, implementing a telescope, or using the liquid crystal (LC) elements (Knittel, et al, 2005, p. 15).

These drives can use automatic ball balancers fitted on a spindle motor of optical disc drives with optical disc use, but should have an operating speed higher than the translational natural frequency of the system being balanced. The nature of red GaInP – AlGaInP epitaxial wafer laser diodes allow them to have many useful applications, and are low cost and compact as well. In fact, other issues are that the temperature distribution of in-land groove phase-change optical disks, the temperature profiles appear to be different between the land track and the groove track, with the thermal cross-track higher than from the groove track to its neighboring land tracks. Scientists are helping to change the industry with new and innovative techniques, and state that the next generation of optical disc units will utilize high numerical aperture (NA) objective lens and discs, which will also include multiple data-layers to compensate spherical aberrations (SA).

There are usually two classes of writers: those who make a conscious decision to pursue writing as a way to support themselves and their families, and those people who find themselves out of work and decide to “try their hand at writing.” If a person finds himself or herself at home writing these days, it won’t matter much which category of writer a person claims to be: they all have the same goal which is to make money from writing.
Writing is a type of business on its own. Freelance writers are able to make their own careers from writing. The writer is more than likely not an employee of the client company being written or contracted out for at any given time. Writers are considered freelance when they are hired for specific writing jobs, assignments or gigs and they are asked to meet the specific needs of a paying client. The client can be a company (large or small), a middle-man who contracts the writer for a client, or even another writer (who has too much work and who wants to share or “farm out” work to another writer).
Beginning freelance writers will enter a maze of writing do’s and don’ts which unfortunately are best learned by just getting booked by clients and developing a reputation as a consistently good writing resource for a client. If a freelance writer writes well, the person will be booked again and again by the client and will be able to develop a rapport with the client that he or she is reliable as a writer of high quality work. This person will get more clients and eventually be able to make a living writing from home.
Because an at home writer is beginning a real business by becoming a freelance writer, it is important to stay professional at all times and to remember that the customer or client who books the writer is actually “the boss.” It is easy to get used to working from home in flannel pajamas and fuzzy slippers, but never let that type of casual attitude spill over into the formal work assignment. Because once a freelance writer is booked for a job, gig or assignment there are real rules that apply and that the freelance writers are expected to adhere to for the client.
First, all deadlines set by the client must be respected. There will be a contract that may be signed by the freelance writer which will outline the parameters of the job – stick to these and follow them to the letter. It is acceptable to ask the client questions about the assignment for clarity, but it is not only to take assignments that the writer has no clue how to perform or complete. For example, if a job requires technical writing and the freelance writer has never done it before then the freelance writer should pass on that writing gig. If a client wants a technical writing on a specific topic that the writer has never written on and will not understand – then that person should not accept an assignment for a “cement-based magnetic-electric traffic control sensor” if the person has no idea what it really is or how it works. The writer should never overreach abilities with a client and should never lie about what the person’s knowledge base is regarding an assignment.
Second, freelance writers need to know that their clients will want to book them again if they are consistently good at what they do. The freelance writer needs to be flexible, accommodating, be ready to modify the assignment or task if asked and should work with the client to overcome any obstacles. The client is the “customer” and that customer is always right (within reason), so the writer needs to do work to make the customer or client happy with the end result.
After the writing is submitted and approved, the client will usually pay for the freelance writer’s services. If the client is satisfied it is acceptable for the freelance writer to ask for more work. And if both accept the relationship, there may be more work going forward and the relationship will grow between the client and the freelance writer.

Case Brief for Westerbeke Corp. v. Daihatsu Motor Co., Ltd., 304 F. 3rd 200 (2002).
Introduction
One party to a supply agreement contract filed a petition to confirm an arbitration award. The U.S. Dist. Ct. for Southern Dist. New York denied the petition and vacated the award. An appeal followed, the Circuit Judge Sotomayor held the District Court decision awarding damages was against NY law that said only reliance damages may be awarded for breach of a preliminary agreement. This did not offer proper deference to the arbitrator’s decision that the defendant treated a contract with a contingency (not a preliminary agreement clause). The arbitrator’s decision could not be set aside, and the award should not be set aside either because the arbitrator did not exceed his authority and the award should stand since it did not use the terms of the contract (per the party’s agreement).
In this case if there is an error or mistake of law, per the manifest disregard standard, the arbitral award can be set aside if 1) the governing law applies to the facts of the case, as the arbitrator determines the facts, and the arbitrator acted with requisite intent, the party moving for setting aside the award can prove that the arbitrator knew about the relevant principle and 2) knew that it controlled the outcome of the disputed issue, and the arbitrator still ignored the governing rule by purposefully refusing to apply it to the case.
In Judge Sotomayor’s opinion, she restates the facts. The arbitration in this case went on for several years and Westerbeke (petitioner) won against Daihatsu in an action for breach of a sales agreement. Westerbeke then filed in U.S. Dist. Ct for Southern District of NY to confirm the $4 million arbitration award per 9 U.S.C. § 9 Daihatsu tried to vacate the award per 9 U.S.C. § 10 (a)(4). The Dist. Ct. held that awarding expectancy damages for breaching a preliminary agreement, the arbitrator acted n disregard of NY law, and denied Westerbeke’s petition, granting Daihatsu’s motion to vacate and remanded to the arbitration tribunal regarding the damages issues.
Judge Sotomayor holds that the Dist. Ct. did not properly consider the arbitrator’s factual determinations and improperly set aside the arbitrator’s interpretation of the sales agreement to be a contract with a condition precedent and not just a preliminary agreement. The problem being that Daihatsu failed to meet its burden to show that the underlying contractual interpretation disregarded NY law, Daihatsu cannot then claim that the arbitrator disregarded NY law by not using principles to show that only reliance damages may appropriately be awarded for the breach of a preliminary agreement. Sotomayor states that Daihatsu’s arguments are without merit in this case in regard to the request for warranting the judgment, and she reversed the judgment to confirm eh arbitral award.
In the background of the case, Westerbeke was a generator manufacturer, and partnered with Daihatsu Corp. The parties entered into a Component Sales Agreement (CSA) where Daihatsu was to supply engines to Westerbeke per the contract, with Westerbeke having some rights to future engine models of Daihatsu (such as right of first refusal). The contract went on for years, then Daihatsu sold its engines to someone else (B&S Company). Westerbeke found this out, and started negotiating on a contract with Daihatsu, but no agreement was ever finalized. Daihatsu said it didn’t want to further contract with Westerbeke, (with timely notice in 1993), the CSA then terminated in 1995. Arbitration began and issues were split as to damages or liability. Daihatsu said a new engine was within Article 3.2 of the CSA only if it desired to sell the engine for marine purposes. Westerbeke said it had the right of first refusal with the engines.
The issues of the case is whether Daihatsu violated the contract with Westerbeke refusing to negotiate engines (g=070) within the context of the CSA. The parties never told the arbitrator what Article 3.2 of the CSA meant. The arbitrator thought the Article 3.2 language mean there was a condition precedent to deciding which engines should fit under the contract definition (or not). The Preliminary Agreement was of two types: a contract with open negotiable terms, and a contract with a condition precedent (where a party has to perform under the obligations of the contract).
After the arbitration award (Interlocutory Award) he damages issues were reviewed. The issue of expectancy damages was raised. Daihatsu claimed NY law limited Westerbeke’s damages to recovering on reliance damages.
The Goldstein case rejected the arbitrator’s conclusion that Article 3.2 made a contract with a condition precedent and that the terms had been satisfied. In this case, the arbitrator determines the facts per his factual findings, and here the arbitrator said there was a condition precedent and that Daihatsu breached its contract. So if Article 3.2 of the CSA stated a condition precedent, Daihatsu could not negotiate a contract with another company. Per the Interlocutory Award here, the arbitrator saw CSA Article 3.2 as a preliminary agreement with open terms between the parties. But in this case, the arbitrator read Article 3.2 to be a contract with a condition precedent (with objective agreement on the sale terms), and the condition was satisfied, so Daihatsu would not sell to others without violating the contract. As a result, the expectancy damages may be allowed to be recovered by Westerbeke or a client similarly situated. The court confirmed the arbitration award, since the arbitrator had valid reasons for awarding the award. The arbitrator was allowed to decide what the CSA Article 3.2 meant, and did decide Daihatsu broke the agreement by selling engines to another party – allowing Westerbeke to recover for damages per the arbitrator’s award.
