Town of Webster Comprehensive Plan
Current Zoning
The entire well field area is zoned R-3 by the Town of Webster12, the highest density of any single family residential zone. Over 135 homes could be built on the well field property, destroying the open space. Uses for R-3 include:
• Single-family detached dwellings.
• Religious uses.
• Fire stations and emergency medical services.
• Public parks or public playgrounds not conducted for profit, including field houses.
• Public, parochial and nursery schools.
• Agricultural uses
• Accessory uses.
• Communications towers upon the issuance of a special use permit by the Town Board.
• Bed-and-breakfasts upon the issuance of a special use permit by the Town Planning Board.
The Town of Webster Comprehensive Plan Update was adopted in 2008 to “update and replace the 2000 Comprehensive Plan.” The well field area is mentioned as a scenic resource9 and as an area of significant natural resources for potential preservation and/or recognition as “an unique environmental area.”10 Furthermore, its value for hiking trails is noted.The 2008 Update references the Town of Webster 2001 Greenprint Plan. This plan detailed areas for future land conservation. 4,000 acres were identified that possessed significant agricultural, ecological, scenic, and open space values. The well field area was included in the land identified for preservation.
An Open Space Overlay District covers only the Village Water Works property; other parcels, such as that owned by Bay Landing, LLC, can be developed with the R-3 zoning.
Overlay District
The Town of Webster placed an Open Space Overlay District13 on the village portion of the well field property in 2003. Without the overlay district, intensive development could occur. The overlay district still allows for some uses including:
• Public-owned parks, including park districts, squares, recreational areas, natural wildlife areas, and other open areas.
• Cemeteries, including associated facilities, botanical gardens, arboretums and conservatories.
• Public marinas, boat launches, boat docks, and fishing docks.
• Outdoor recreational facilities, such as hiking and bicycle trails, greens and commons, sitting areas, and picnic areas.
• Public schools.
• Communications installations, freestanding towers, satellite dishes, antennas and poles.
• Properties where the Town has purchased the development rights (PDR). The uses in existence at the time the PDR was acquired shall continue. Expansion of uses on the property shall be subject to those allowed under the agreement that the PDR was acquired
