591. Caswell County, NC, Indentures, 1788, #239. James Bankson to Jacob Bankson. The deed of 1 Jan 1788 executed by James Bankson, "heir at law" and oldest grandchild of Capt. Lawrence Bankson, deceased. The term "heir at law" refers to one who owns land by operation of the law, rather than by deed or by a will specfically bequeathing the land. The property usually passes from the deceased to the eldest son, or if he is dead, then to the eldest son's eldest son. If the eldest son died without heirs, then his eldest brother (or his heir) would be the "heir at law." Thus there is only one "heir at law". Where the law of primogeniture is strongly followed, the rights of the eldest son to inherit can not be overturned, even by a will. Since James Bankson was the "heir at law" in 1788 and the oldest grandchild, then his father had to be deceased. Peter Bankson was still alive in l788, so he was not the eldest son or the father of James. Andrew Bankson lived in Caswell Co., NC in 1777, and died in Montgomery Co. where his estate was inventoried in 1783.
