6.1 Work Periods
6.1.1 Regular Workweek
Normally, the workweek shall consist of five (5) consecutive days, (Monday through Friday) of eight (8) hours for full-time employees or specified hours for part-time employees.
6.1.2 Alternative Workweek
If it becomes necessary for the efficient operation of the District to change the Monday-Friday workweek for any employee, the District will notify the affected employee ten (10) days prior to making a change in the workweek. If the employee does not agree to the change, the District will notify CSEA and may implement such change. The employee may file an appeal with the Board over the changed workweek.
6.1.3 Workday
The length of the workday shall be designated by the District for each classified assignment. Each bargaining unit employee shall be assigned a fixed, regular and ascertainable minimum number of hours.
6.1.4 Lunch Periods
All employees working four (4) hours or more shall be entitled to an uninterrupted lunch period of at least one-half (1/2) hour. In the event of an emergency as determined by the employee’s direct supervisor (fire, earthquake, lockdown, etc), an employee’s lunch period may be interrupted in order for the employee to perform activities as directed by the supervisor; in which event, the employee will be provided:
a. the balance of their thirty (30) minute lunch period lost/interrupted, or;
b. compensated at the appropriate rate for the lost or interrupted lunch period, and;
c. compensated at the appropriate rate for all additional time the employee may otherwise be entitled to.
The lunch shall be mutually scheduled to accommodate program needs.
6.1.5 Rest Breaks
Each employee will be entitled to a paid fifteen (15) minute rest break for each full four (4) hours worked. Employees working two (2) to four (4) hours shall be entitled to a paid rest break of ten (10) minutes.
6.1.6 Rest Facilities
The District shall make available at each work site adequate lunchroom, and restroom.
6.1.7 Time Worked
For the purpose of computing the number of hours worked, time during which an employee is excused from work because of holidays, sick leave or other paid leaves of absence shall be considered as time worked by the employee.
6.1.8 Working Hours
Working hours are all hours in paid status.
6.2 Changes in Assigned Time
6.2.1 Reduction in Assigned Time
Any reduction in assigned time shall be accomplished in accordance with the layoff and reemployment article.
6.2.2 Temporary Increase In Hours
The Superintendent or his designee may assign additional temporary hours to any part-time unit member at a site for a maximum of sixty (60) consecutive duty days subject to section 6.14.
6.2.3 Short-Term Increase In Hours
a. The Superintendent or his/her designee may make short-term hours available to part-time unit members. Short-term hours means an extra hour(s) assignment lasting not beyond the end of the current school year.
b. All short-term hour assignments shall be posted at each work site for five (5) work days. The notice shall contain a description of the assignment, the work site, the number of hours per day, the expected duration of work, and the deadline for filing. Any part-time employee may apply. If one employee applies and is qualified, he or she shall receive the extra hours.
c. If more than one (1) part-time employee applies, the selection process under section 13.4.4 shall apply. The short-term assignment is subject to section 6.2.5.
6.2.4 Permanent Increase in Hours
When additional hours are assigned to a part-time position on a permanent basis, the assignment shall be offered to the employee working in the position when the hours are being increased.
6.2.5 Limitations on Non-Permanent Increases In Assigned Time
a. Non-permanent increases in hours are assignments which are not expected to continue in the future (sections 6.2.2, 6.2.3).
b. Any employee in the bargaining unit who works a minimum of thirty (30) minutes or more per day in excess of their regular part-time assignment for a period of twenty (20) working days or more shall have their vacation, sick leave and holiday allowance adjusted upward on a pro rata basis to reflect the longer hours. Any employee receiving non-permanent additional hours shall not be entitled to a permanent increase in hours, to health benefits or PERS benefits as a result of such hours.
6.3 Overtime
6.3.1 Definition
Overtime is defined to include any time worked in excess of eight (8) hours in any one (1) day or any one (1) shift or in excess of forty (40) hours in any calendar week, whether such hours are worked prior to the commencement of a regularly assigned starting time or subsequent to the assigned quitting time.
6.3.2 Right of Refusal
Except as provided in Section 6.1.4, any employee shall have the right to reject any offer or request to work overtime except in the case of a bona fide emergency as determined by the employee’s supervisor or designee.
6.3.3 Requested by Supervisor
An employee shall not work overtime, except in cases of emergency, unless he or she is requested to work by the immediate supervisor or designee.
6.3.4 Compensatory Time Off/Overtime Pay
The District shall notify an employee in advance of working overtime if the time will be compensated by compensatory time off in lieu of cash compensation. Compensatory time off shall be granted at one and one-half (1-1/2) hours for each hour of overtime worked. Compensatory time shall be taken at a time mutually acceptable to the employee and the District within twelve (12) months of the date on which it was earned, or the District shall pay the employee at the appropriate overtime rate. If overtime is paid, all overtime hours shall be compensated at a rate of pay equal to time and one-half the regular rate of pay of the employee.
6.3.5 Overtime - Equal Distribution
Overtime shall be distributed and rotated as equally as is practical among employees in the bargaining unit within each work site.
6.3.6 Overtime Records
All overtime worked and the appropriate pay rate or compensatory time off status shall be reported on the employee’s time sheet.
6.4 Call In/Call Back Duty
6.4.1 Right of Refusal
Any employee shall have the right to reject any offer or request for call back, on call or call-in time except in the case of an emergency.
6.4.2 Minimum Call In Time
Any employee called in to work on a day when the employee is not scheduled to work shall receive a minimum of two (2) hours pay at the appropriate rate of pay.
6.4.3 Call Back Time
Any employee called back to work after completion of his/her regular assignment shall be compensated for at least two (2) hours of work at overtime rate and the remainder at the appropriate rate irrespective of the actual time worked.
6.4.4 Crossing Guard Limitations
a. The District may continue to use volunteers or employ persons in nonunit positions for crossing guard assignments beyond three (3) positions.
b. If the District cannot fill any crossing guard position after posting for twenty (20) work days, the parties agree to reopen negotiations over this subject.
6.5 Summer Work
6.5.1 For the purposes of this section, every classified employee shall be deemed to be employed for twelve (12) months during each school year regardless of the number of months in which he or she is normally in paid status.
6.5.2 When the District maintains school sessions during the summer, the District will post the positions by classification as soon as the District knows there will be summer assignments and will post them for no less than five (5) working days.
6.5.3 The assignment of classified employees who file for the summer work shall be by seniority within the classification posted.
6.5.3.1 If a student with special needs that has an Individual Education Plan (IEP) is attending Extended School Year (ESY) the District may assign an aide that has experience with that student’s needs who has applied for ESY regardless of seniority.
6.5.4 The District shall pay the classified employee for the additional assignment, not less than the compensation and benefits that are applicable to the classification of the additional assignment that is applicable to the classification of the additional assignment during the school year.
