2.1 Chapter Rights
CSEA Chapter #571 shall have the following rights in addition to those rights provided by law:
2.1.1 Consult on Board Policies
CSEA may make recommendations regarding any administrative or Board policies affecting employment conditions or employer-employee relations including, but not limited to, salaries and other terms of conditions or employment. Nothing shall preclude the Board of Trustees from hearing and acting upon the presentations made by individual employees on individual matters that are not within the scope of representation.
2.1.2 Access to Work Areas
The right of access at reasonable times to areas in which employees work, for the purpose of representing bargaining unit members, as long as no interference occurs with the employee’s duties.
2.1.3 Communications
The right to use, without charge, institutional bulletin boards, mailboxes and the use of the school mail system and other District means of communication for the posting or transmission of information or notices concerning CSEA matters.
2.1.4 Equipment
The right to reasonable use, without charge, of institutional equipment, facilities and buildings at reasonable times for the purpose of organizational business related thereto, as long as no interference occurs with the educational program.
2.1.5 Seniority Roster
a. The right to receive a complete seniority roster of all bargaining unit employees annually. The roster shall indicate each employee’s present classification and primary job site.
b. All employees in any job class which may be affected by a layoff shall receive an updated seniority roster prior to implementation of the layoff.
2.1.6 Information
The right to receive, upon request and without cost, copies of any and all materials related to wages, hours and other terms and conditions of employment which are relevant for CSEA to fulfill its duties and obligations as the exclusive representative of bargaining unit employees.
2.1.7 Release Time for Officers
The right of unpaid release time for employees who are CSEA state officers to conduct necessary CSEA business (not to exceed five (5) days per school year).
2.1.8 Release Time for CSEA Conference
The right of unpaid release time for the CSEA Chapter President or designee to attend the CSEA Annual Conference.
2.2 Organizational Security
2.2.1 Membership Dues
CSEA shall have the sole right to have membership dues deducted for employees in the bargaining unit. The District shall, upon appropriate written authorization from any employee, deduct and make appropriate remittance for CSEA membership dues.
2.2.2 Revoking Dues
a. Each CSEA member shall continue to pay dues for the duration of the fiscal year.
b. Bargaining unit members who wish to revoke their dues authorizations shall first be referred to CSEA in accordance with SB 866.
2.2.3 Hold Harmless / Indemnification Agreement
The Association agrees to pay to the District all reasonable legal fees, legal costs awards, or judgments incurred by the District in defending against any court action and/or administrative action before the Public Employment Relations Board challenging the legality or constitutionality of the provisions of this Agreement or their implementation. Such payment shall be tendered monthly upon presentation of a written statement by the District.
2.3 District Rights
2.3.1 Board Rights and Powers
a. The Board retains all of its powers and authority to direct, manage, and control to the full extent of the law, including but not limited to, the exclusive right to: determine its organization; direct the work of its employees; determine the locations and hours of operation; determine the kinds and levels of services to be provided and the methods and means of providing them; establish educational policies, goals, and objectives; determine staffing patterns; determine the number and kinds of personnel required; maintain the efficiency of District operations; determine the curriculum; build, move, or modify facilities; establish budget procedures and determine budgetary allocations; determine the methods of raising revenue; and take action on any manner in the event of an emergency. In addition, the Board retains the right to hire, classify, assign, evaluate, promote, terminate, and discipline employees.
b. The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the Board, the adoption or rescinding of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the terms of this Agreement and then only in accordance with law.
