International Leadership of Texas offers school nursing and health care services on every campus. Due to the complex needs of some students a parent may elect to have Private Duty Nurse (PDN) care for their child. The PDN would accompany the child to school and provide medically necessary services as prescribed by a doctor. International Leadership of Texas holds no employment relationship with the contracted agency or private duty nurse.
When the campus is notified that a student is in need of a PDN, the following must occur:
Obtain a copy of the Physician's orders indicating that services must be provided to ensure FAPE.
Contact the area director and the campus nurse; send them a copy of the Physician's orders.
The Area Director and/or Campus Nurse notify HQ as well as the Director of Nursing.
Schedule an IEP/ARD committee meeting to discuss developing a Health Service Plan (include ALL required and additional service providers, including the campus nurse).
A background check must be completed. The PDN must provide his/her name and number to HR to have one completed.
Once cleared, the PDN must sign the Private Duty Nurse Agreement Form and the Authorized Release of Confidential Information (in Project Education).
Guidelines:
Parent/Guardian
The parent/guardian wishing to start private duty nursing services for a child must:
Inform the IEP/ARD committee that they are waiving ILTexas health services and wish to provide their own nurse. They must acknowledge that they understand that they are responsible for this expense. (This conversation is guided and practiced at the staffing)
Read the ILTexas Private Duty Nursing Guidelines.
Complete a Parent Agreement for Private Duty Nursing Services and provide it to ILTexas. This serves as the official request for PDN services.
Submit the signed Parent Agreement for Private Duty Nursing Services to the Special Education Department.
Private Duty Nurse
The private duty nurse is responsible for providing a copy of the most recent or updated medical orders and MAR (medication administration records) to the school nurse within 1 school day of changes.
The private duty nurse should have weekly communication with the campus nurse regarding the student’s medical needs.
The private duty nurse should sign in and out at the front desk by showing their driver's license.
If the private duty nurse must leave campus for any reason, they must notify the classroom teacher and the campus nurse. If the private duty nurse must leave the classroom for any reason, they must notify the classroom teacher and/or other professionals.
The private duty nurse must maintain the privacy and confidentiality of all students and protect against disclosure of confidential information and records, including but not limited to information and records protected by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) which mandates the protection and privacy of health information and the Family Educational Rights and Privacy Act (FERPA) which protects student records and information.
The private duty nurse must not video record, audio record, and/or photograph students or campus staff for any reason.
The private duty nurse is only responsible for medical services for her or his client and shall not provide medical services of any type to any other students, staff, or visitors.
The private duty nurse shall make every effort to ensure that the medical services she or he provides to her or his client shall be non-disruptive and non-intrusive and not disrupt the student's individual education plan.
The private duty nurse must always wear a name badge when present on any property owned by the district, including the nurse’s name and title.
The private duty nurse shall follow all classroom, campus, and district health and safety procedures, including hand washing, cleaning, and hygiene.
The private duty nurse must sign the PDN Agreement form.
If the private duty nurse is going to be absent his/her agency should provide coverage for the PDN. The PDN must provide notice of the absence and his/her replacement information to the principal and campus nurse.
Teacher and Staff:
Teachers and other school staff shall not expect or request the private duty nurse to assist with any medical or other tasks for students other than the private duty nurse’s client.
Teachers and other school staff shall consider the student’s medical needs and schedule when planning the student’s educational program.
Teachers and other school staff shall not share educational information with the private duty nurse unless it is necessary for medical planning purposes for her or his client.
Teachers shall direct the private duty nurse to the campus nurse if there is knowledge of any changes in the student’s medical needs or care.
If there is any concern regarding the provision of medical services or care by the private duty nurse, the teacher and/or other school staff shall notify the parent, the campus Principal, the assigned Special Education Campus Coordinator, and the campus nurse.
Teachers shall post instructional schedules and classroom procedures regarding safety, including hand washing, cleaning, and hygiene.
One the campus nurse is notified that the PDN will be absent, she/he will notify the Director of Health Services and the SPED Campus Coordinator.
