An ARDC meeting shall be held within 30 calendar days from the date of the completion of the initial Full Individual Evaluation. If the 30th day falls during the summer and school is not in session, the ARDC shall have until the first day of school to finalize decisions concerning the initial eligibility determination, the IEP, and placement unless the Full Individual Evaluation indicates that the student will need Extended School Year Services (ESY) during that summer.
If a student meets eligibility for a category of disability, an Initial ARDC meeting is held. The Initial ARD committee meeting must be held within 30 calendar days of the date of the completed evaluation. In the event that the parent is non-responsive to communication regarding the Initial ARD committee meeting, a notice of the ARDC meeting (ARD Invitation/Notice of IEP Meeting) is sent, and the Initial ARDC meeting is held without the parent. The school district proposes the IEP and services and then sends a copy of the Initial ARDC meeting (IEP - Initial) to the parent. The Consent for Initial Placement form must be signed by the parent prior to special education services being implemented.
NOTE: If the due date of the Initial ARD falls on the weekend or a holiday, the ARD must be held before the due date.
The following members should be included in each ARD meeting:
The parents of the child;
Not less than one general education teacher of the child (if the child is, or maybe, participating in the regular education environment);
Not less than one special education teacher of the child, or where appropriate, not less than one special education provider of the child;
Local Education Agency Representation – Campus Administrator or Campus Coordinator. While the Campus Coordinator may serve in the role of the LEA Representative, it is not recommended that they be the only campus administrator in ARDC meetings for any given campus.
Evaluation Specialist
At the discretion of the parent or ILTEXAS, other individuals who have knowledge or special expertise regarding the child, including the following as appropriate:
Related and/or instructional services personnel
LPAC representative if the student is identified as Emergent Bilingual
CTE representative, if the student has CTE classes or CTE classes, will be considered
To the extent appropriate, with the consent of the parents or a child who has reached the age of majority, a representative of any participating agency that is likely to be responsible for providing or paying for transition services.
Whenever appropriate, the child with a disability.
A certified teacher of the Deaf/Hard of Hearing when the student’s disabling condition is Deaf/Hard of Hearing or Deaf-Blind.
A teacher certified to teach students with vision impairment when the student’s disabling condition is vision impairment.
The adult student or LEA may invite individuals who have knowledge or special expertise regarding the adult student, including the parent, to be a member of the ARD committee.
Consent to Excuse Member from Attending an ARDC Meeting (TAC 89.1050(c)(5))
While the Texas Administrative Code allows for an excusal process, ILTEXAS has elected to NOT excuse required ARD committee members for part or all of an ARD meeting.
If a non-required ARD member needs to miss a portion of an ARD, the Campus Coordinator should ask the parent’s permission for the person to present their information and then leave. The parent must indicate consent and sign the Parent Consent to Excuse Members from an IEP Meeting form in Project Education. If the parent agrees to allow the person to leave, this should be documented in the ARD deliberations, noting the time at which the non-required ARD member left the ARD committee meeting.
NOTE: A teacher cannot serve as both the general and special education teacher .
The Administrator cannot serve as both the LEA representative and the LPAC representative.
