Earnings
How does Prop 22 affect how I'm paid?
As a delivery partner in California, you are guaranteed to earn at least 120% of the local minimum wage at your pickup location, plus $0.34 for each mile driven during engaged time. This is your Prop 22 net earnings floor.*
If you are owed an adjustment to meet the Prop 22 net earnings floor, you will see it shown on the Earnings page in your Weekly Summary under Prop 22 Earnings Adjustment. (See example)
The Prop 22 Earnings Adjustment is calculated as follows:
Prop 22 net earnings floor
- All non-tip earnings (e.g. Base Pay, GoMissions...)
= Prop 22 Earnings Adjustment
And of course, you will always receive 100% of tips.
For example, let’s say you made one delivery in a week, and the following were true:
Minimum wage in the pickup location in California is $15 per hour
Engaged time for the delivery was 15 minutes (or 0.25 hours)
Mileage driven for the delivery was 8 miles, and you used your motor vehicle
Your Prop 22 net earnings floor would be: ((120% x $15) x 0.25) + ($0.34 x 8) = $7.22.
*In May 2023 the California State Treasurer’s Office published their updated per-mile rates for 2022 and 2023. The newly adjusted per-mile rates are listed below, and were applied retroactively for 2022 and 2023.
2022 → $0.32 per mile
2023 → $0.34 per mile
What does "engaged time" mean?
Engaged time is the period of time from when a driver accepts an offer to when the driver completes the order, or to the time when the order is canceled by the customer or Gopuff.
You will not be paid for engaged delivery time if you abandon or choose not to complete the delivery after you have accepted the offer, or if other fraud is detected by GBL California.
Will the changes to earnings impact my tips?
No, you will still receive 100% of your tips.
How is local minimum wage calculated?
The local minimum wage is based on the location of the micro-fulfillment center (MFC) or BevMo! store.
Healthcare
What is healthcare subsidy under Prop 22?
If you are enrolled in a qualifying health plan, meet average minimum active and engaged hour requirements over the calendar quarter, and provide proof of enrollment when requested, you may be eligible to receive a healthcare subsidy from GBL California.
How does the subsidy work and how much is the subsidy?
To qualify for a healthcare subsidy, you must meet these requirements:
Active and engaged delivery time of at least 15 hours per week averaged over the calendar quarter
Submit your proof of health insurance within 15 days of the end of the calendar quarter
Have a qualifying healthcare plan. A qualifying healthcare plan is an insurance plan for which you’re the subscriber, and is not Medicare, Medicaid, or an employer-sponsored plan
Once you meet these requirements, you’ll receive one of two subsidies based on your average active delivery time over the quarter.
Level 1: Drivers with an active delivery time of at least 15 hours, but less than 25 hours per week on average over the entire quarter.
Subsidy Payment: 41% of the average Covered California premium
Level 2: Drivers with an active delivery time of 25 hours per week or more on average over the entire quarter.
Subsidy Payment: 82% of the average Covered California premium
How do I know if I am eligible for a healthcare subsidy and when will I receive payment?
You will be notified on a quarterly basis if you are eligible to receive a healthcare subsidy. At that time, you will be requested to provide proof of current enrollment in a qualifying health plan. The quarters in a calendar year are as follows:
January - March
April - June
July - August
October - December
You have 15 days after the close of each quarter to submit your proof of current enrollment. If your proof of current enrollment is accepted, you can expect to receive a subsidy within 15 days of submission of the proof of enrollment.
What forms of health insurance are accepted?
In order to qualify for the healthcare subsidy, you must provide one of the following forms of proof of current enrollment:
Proof of health insurance membership
Valid health insurance identification cards
Evidence of coverage and disclosure forms from your health plan
Claim forms and other documents necessary to submit claims

What are GBL California's policies for Anti-Discrimination, Anti-Harassment, and Zero Tolerance?
How do I report an incident pertaining to the Zero Tolerance and/or Anti-Discrimination & Anti-Harassment policies?
To report a violation of either policy, please notify a local Gopuff employee or email partners@gopuff.com. Any such reports will be treated as confidential to the extent practicable.
What is the mandatory rest period and is it necessary?
The mandatory rest period is a California state-mandated 6-hour rest period that you must take after being logged into the Gopuff Driver app for 12 cumulative hours within a 24-hour period. To help you meet this requirement, you're encouraged to choose your times accordingly, not exceeding 12 hours within a 24-hour period.

Appealing Account Deactivation
Who is eligible for the appeal process according to Prop 22?
Delivery partners in the State of California who received notification of contract termination.
How can I appeal if I receive notice of contract termination?
The option to appeal a contract termination will be detailed at the end of the relevant contract termination email. You will have up to one week to submit any relevant information pertaining to a contract termination appeal by emailing driverengagement@gopuff.com.
How will I know if my appeal has been accepted or denied?
If the decision to terminate the contract is reversed due to new information pertaining to the reason for termination, you will receive notice via email that your contract with GBL California, LLC has been reinstated. You will be promptly reactivated and added back to the platform.
