These Terms of Use ("Terms") govern your access to and use of the website located at https://sites.google.com/view/unblockedgames-portal/ (the "Site" or the "UGP"). By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, you should not access or use the Site.

1. Use of the Site

The Site allows you to access and play a variety of online games. You may use the Site for personal, non-commercial purposes only. You may not use the Site for any illegal or unauthorized purpose, including, but not limited to:

• Distributing, creating, or participating in such creation or distribution of false, inaccurate, or misleading information to users of the Site or developers of the Site or the use of the Site to facilitate such activity. 

• Orchestrating or participating in unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation directed at users or developers or the use of the Site to commit such activity.

• Sharing obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by the UGP) messages or content with the use of the Site or to users of the Site. 

• Ridiculing, mocking, disparaging, intimidating, or abusing anyone with the use of the Site or to the users or developers of the Site.

• Harassing or threatening (in the legal sense of those terms) any other person and/or promoting violence against a specific person or class of people.

• Violating any applicable law, regulation, or rule.

• Violating the privacy or publicity rights of any third party.

• Violating any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors.

• Offensive comments or content that are connected to race, national origin, gender, sexual preference, or physical handicap.

• Violating, or linking to material that violates, any provision of these Legal Terms, or any applicable law or regulation.

2. Data Collection & Sharing

The continued use of the Site means that you consent to the Site collecting data such as your IP address, location (from IP address), browser, computer operating system, ISP, etc using a third-party service. Data is also collected with the use of Google Analytics including, but not limited to location, engagement time, and pages visited on the Site. We collect this data to make the Site more user-friendly and to understand how users interact with the Site. We will not disclose your information to third parties or the authorities unless it is required by law to do so. The Site is hosted by Google Sites and they may collect other information or share such information in a way that is not endorsed or controlled by the UGP.

3. Content

The Site contains content, including games, sites, text, and other materials (the "Content"). The Content is protected by copyright, trademark, and other intellectual property laws unless otherwise mentioned. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content without the prior written consent of the owner unless otherwise mentioned. Most of the Content on the Site is owned by third parties unrelated to or controlled by the Site except for any of the UGP Originals, which are hosted on glitch.com.

4. Third-Party Links

The Site contains links to third-party websites or services that are not owned or controlled by the UGP. These links are provided for your convenience only and do not constitute an endorsement by the UGP of the content on such websites or services. We are not responsible for the content or practices of any linked and/or embedded websites or services or any violation of laws committed by these third-party sites or services. You access any third-party websites or services at your own risk.

5. Indemnification

You agree to indemnify and hold harmless the UGP, its affiliates, and their respective developers, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third party rights.

6. Disclaimer

The Site and the Content are provided "as is" and without warranties of any kind, express or implied. We disclaim all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. We are not responsible for any rule-breaking or punishment due to any rule-breaking that may occur due to the use of our site in schools, workplaces, etc and we recommend you check the rules of any schools, workplaces, etc that you may be using the Site in to prevent such events happening.

7. Limitation of Liability

We shall not be liable for any damages arising out of or in connection with your use of the Site, including, but not limited to, direct, indirect, incidental, consequential, special, or punitive damages. We are also not liable for any damages caused by the use of third-party sites embedded or linked in the Site.

We may terminate your access to the Site at any time, for any reason, without notice if we deem it necessary.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

These Terms constitute the entire agreement between you and the UGP with respect to your use of the Site.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
