Safety Disclaimer for Rate My Ditch

Rate My Ditch is operated by Alexander Ottolangui, operating under the app studio name Rate My Fav Apps ("we", "us", or "our").
This Safety Disclaimer explains important safety rules and warnings for using Rate My Ditch. It should be read alongside the Terms of Use, Community Guidelines, Privacy Policy, and Moderation and Reporting Policy.

Important: A ditch appearing in the app, receiving a high rating, being shared, or being visible to friends does not mean it is safe or lawful to visit.
Rate My Ditch is a humorous entertainment app that allows users to find, create, rate, review, save, and share ditch locations on a map.
The app is intended as a joke/social review experience. It should not be interpreted as advice, encouragement, approval, or a recommendation to visit, approach, enter, sleep in, drink near, or spend time in a ditch or any other outdoor location shown in the app.
A high rating, positive review, public listing, Friends-only listing, shared link, leaderboard position, image, or other app feature does not mean that a location is safe, lawful, accessible, suitable, or appropriate to visit.
Rate My Ditch does not provide safety advice, travel advice, navigation advice, outdoor activity advice, legal advice, emergency guidance, or professional risk assessments.
Ratings, reviews, descriptions, photographs, map markers, coordinates, usernames, and other information displayed in the app may be created by users or supplied through third-party map and location services. They should not be relied upon as accurate, complete, current, safe, lawful, or suitable for any purpose.
You are responsible for making your own safe and lawful decisions and, where appropriate, checking official information, signs, access restrictions, weather conditions, and local guidance before going anywhere.
You should not enter, approach, access, or remain in any location that may be unsafe, restricted, private, hazardous, or otherwise unsuitable.
· ditches, drains, culverts, channels, or similar features
· roadsides, road verges, bridges, tunnels, or areas exposed to traffic
· rivers, streams, canals, reservoirs, flood channels, or other waterways
· construction sites, industrial sites, utility infrastructure, or derelict structures
· farmland, private land, gardens, homes, workplaces, schools, or other private property
· railway tracks, railway land, stations, depots, or other railway areas
· steep, unstable, slippery, flooded, isolated, poorly lit, or hazardous ground
· restricted areas, closed land, fenced areas, or places where access is not clearly permitted
· any place where signs, barriers, warnings, conditions, or common sense indicate that you should not enter or remain
If a location appears unsafe, private, restricted, inaccessible, or unsuitable, do not visit it or enter it. The fact that a location appears in Rate My Ditch does not give you permission to access it.
Rate My Ditch does not encourage, recommend, endorse, or organise unsafe or unlawful behaviour.
· sleeping in ditches or other unsafe outdoor locations
· drinking outdoors because of the app
· entering ditches, drains, waterways, or hazardous terrain
· trespassing or entering private land without permission
· entering restricted, closed, or dangerous areas
· approaching traffic, roadsides, construction sites, railway areas, or other hazards
· taking risks to create content, obtain photographs, improve a rating, complete a challenge, or appear on a leaderboard
· putting yourself or another person at risk
· breaking local laws, access rules, warnings, or regulations
Users must not use the app, reviews, profiles, friend features, shared links, or any other app feature to encourage, promote, organise, pressure, dare, or glorify unsafe or illegal behaviour.
The app may display map information, user-created ditch markers, coordinates, nearby locations, search results, and your current location while the app is open or actively being used.
Map data, place-search results, GPS/current-location information, user-created markers, and user-submitted coordinates may be inaccurate, incomplete, delayed, outdated, misplaced, misleading, or unavailable.
We do not guarantee that any location shown in the app:
· exists or still exists
· is positioned accurately on the map
· is safe or free from hazards
· is legal to access
· is publicly accessible
· is open or available
· is suitable to visit
· is reachable by a safe route
· is accurately described by users
Do not use the app while driving, cycling, crossing roads, walking in hazardous terrain, or in any other situation where looking at a device could distract you from your surroundings.
Always follow local laws, signs, barriers, access restrictions, official warnings, and common sense.
Rate My Ditch may allow a ditch to be set as Public or Friends only. These are content-visibility settings, not safety classifications.
A Public ditch is not necessarily safe, lawful, publicly accessible, or suitable to visit. A Friends-only ditch is not necessarily safer, more private in the real world, or more appropriate to visit.
Users may be able to share links to ditches through messaging or other apps. Receiving or opening a shared link does not mean that Rate My Ditch, the creator, the person who shared it, or any other user has checked the location for safety or legality.
A Friends-only link does not grant permission to view the ditch unless the recipient is otherwise authorised in the app, and it does not grant permission to enter or visit the real-world location.
By using Rate My Ditch, you are responsible for your own decisions, conduct, safety, and legal compliance.
· deciding whether any place is safe or appropriate to approach or visit
· checking whether access is lawful and permitted
· following local laws, signs, barriers, landowner restrictions, and official guidance
· avoiding private, restricted, hazardous, flooded, unstable, or unsafe places
· considering weather, lighting, traffic, terrain, water, and other changing conditions
· not putting yourself or another person at risk
· not relying on Rate My Ditch as your only source of information about any location or route
· not creating content where doing so would require unsafe, unlawful, or intrusive behaviour
If you are unsure whether a location is safe or lawful to access, do not enter it.
Rate My Ditch is not an emergency service and should not be used to request urgent help, report an emergency, or obtain emergency guidance.
If you or someone else is in immediate danger, contact the appropriate emergency services for your location. In the United Kingdom, call 999 in an emergency.
Do not wait for a Rate My Ditch report, support request, moderation review, notification, or other app response in an emergency.
Rate My Ditch includes user-generated content such as ditch names, descriptions, ratings, reviews, images, map markers, coordinates, usernames, and profile information.
User-generated content may be inaccurate, incomplete, outdated, offensive, unsafe, misleading, malicious, or otherwise unsuitable. It may also fail to reflect changing real-world conditions.
Users must not upload or share content that encourages unsafe activity, trespassing, illegal behaviour, harassment, abuse, threats, dangerous challenges, or harm. Users must not falsely present private, restricted, or hazardous property as safe or publicly accessible.
We may remove, restrict, or otherwise moderate content that we believe creates safety, legal, privacy, abuse, moderation, or app-integrity risks.
Rate My Ditch includes in-app reporting for supported ditch locations, reviews, and users. Available report reasons include offensive or abusive content, unsafe locations, spam or fake content, inappropriate images, personal information, and other concerns.
You can also report safety concerns or content issues by emailing ratemyditch@gmail.com. Please provide enough information to help identify the relevant content, such as the ditch name, review title, username, location details, screenshot, or other useful context.
The app also includes blocking features for signed-in users. Blocking is intended to help manage your interaction with another account; it is not an emergency or safety-reporting system and does not guarantee that another person's content will disappear from the service for everyone.
Moderation is currently manual. Reports may be reviewed and acted upon, but reporting content does not guarantee immediate removal or any particular moderation outcome.
We may investigate reports and remove, hide, restrict, or otherwise moderate content or accounts where appropriate, but we do not continuously verify every location or monitor every item of user-generated content.
We cannot guarantee that all unsafe, inaccurate, illegal, inappropriate, or harmful content will be identified, reported, reviewed, corrected, or removed immediately.
You should always use your own judgement and avoid unsafe or unlawful situations regardless of whether content has been reported, reviewed, removed, shared, rated highly, or left visible in the app.
To the fullest extent permitted by law, we are not responsible for injury, loss, damage, legal issues, or other consequences arising from:
· using or being unable to use the app
· relying on user-generated content, ratings, reviews, images, coordinates, or map information
· visiting or attempting to visit a location shown or shared through the app
· entering or approaching unsafe, private, restricted, flooded, unstable, or hazardous locations
· trespassing, ignoring warnings, or breaking local laws or access restrictions
· inaccurate, incomplete, delayed, or misleading map, GPS, place-search, or location information
· unsafe, unlawful, misleading, or inappropriate behaviour by users
· actions taken because of a rating, review, image, notification, leaderboard, friend interaction, or shared link
· third-party maps, messaging services, Firebase services, or other external services used by or alongside the app
Nothing in this Safety Disclaimer excludes or limits liability, rights, or remedies that cannot lawfully be excluded or limited.
We may update this Safety Disclaimer when the app, its safety features, or relevant legal and operational requirements change.
If we make significant changes, we may notify users through the app or by other appropriate means. The latest version should be available through the app or the Rate My Ditch public support site.
