VIDIOAI - Terms of Use (EULA)

Thank you for using VIDIOAI by King Apps Studio. By downloading, installing, or using this app, you acknowledge that you have read and accepted the following Terms of Use. If you do not agree, do not use the app.
Acceptance of Terms
By using VIDIOAI, you agree to be bound by these Terms of Use, our Privacy Policy, and Apple's standard End User License Agreement (EULA) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms apply to all users of the app.
User Content and Photo Uploads
2.1 You retain ownership of any photos, images, or text prompts you submit to VIDIOAI for AI generation.
2.2 By uploading a photo or submitting a prompt, you grant King Apps Studio and our third-party AI model providers a limited, temporary license to process that content solely for the purpose of generating your requested video output. This license ends when your generation request is completed.
2.3 You confirm that you have the right to upload any photo you submit, including photos of other people. You must obtain consent from any individual whose face or likeness appears in photos you upload for AI generation.
2.4 You must not upload photos of minors for AI generation or animation purposes.
2.5 You are solely responsible for the content you submit, including ensuring it does not violate any applicable laws or third-party rights.
Face Data and Biometric Information
3.1 Certain features of VIDIOAI allow you to upload photos that may contain facial images. By using these features, you explicitly consent to the collection and processing of face data as described in our Privacy Policy.
3.2 Face data contained in your uploaded photos is transmitted to third-party AI model providers (including Kling AI, Google, OpenAI, Seedance, and WAN) solely to fulfill your generation request. It is not stored by King Apps Studio beyond the processing window, and it is not used for identification, profiling, or advertising.
3.3 You must not upload photos of other individuals without their explicit consent to have their facial image processed by AI generation systems.
AI-Generated Content
4.1 VIDIOAI uses third-party AI model APIs to generate video content from your inputs. These providers include Kling AI (Kuaishou Technology), Google (Veo 3, Veo 3.1), Seedance (ByteDance), and WAN. VIDIOAI is not affiliated with, endorsed by, or an official product of any of these companies.
4.2 AI-generated video output may vary in quality, accuracy, and appearance. We make no guarantee that generated content will meet your specific expectations.
4.3 You own the output videos you generate using VIDIOAI, subject to the terms of the underlying AI model providers and applicable law. You are responsible for how you use, share, or publish generated content.
4.4 You agree not to use AI-generated output from VIDIOAI to create content that is defamatory, deceptive, harmful, or that violates any law or third-party rights.
Prohibited Use
You agree not to use VIDIOAI to:
Upload or generate content that is unlawful, abusive, harmful, sexually explicit, or violates any applicable law.
Generate content that depicts real individuals without their consent, including deepfakes or misleading impersonations.
Upload photos of minors for AI animation or generation.
Infringe on intellectual property rights of any third party.
Attempt to reverse engineer, decompile, or extract the AI models used in the app.
Use the app for automated or bulk generation without authorization.
Violate any terms imposed by our third-party AI model providers.
Violation of these rules will result in the termination of your access to the app.
Subscriptions and Credits
6.1 Auto-Renewal Subscriptions: VIDIOAI offers auto-renewing subscription plans. Your subscription will renew automatically unless cancelled at least 24 hours before the renewal date. Your iTunes account will be charged at purchase and within 24 hours before each renewal period.
6.2 Credit Rollover: Unused credits from your active subscription carry over while your subscription remains active.
6.3 One-Time Credit Packs: Credits purchased as one-time packs are valid for 365 days from the date of purchase and remain available regardless of subscription status.
6.4 Cancelling Subscriptions: To cancel, go to your device Settings, then Subscriptions, and select VIDIOAI. Cancellation prevents future renewals but does not refund the current subscription period.
6.5 No Refunds on Used Credits: Credits consumed for AI video generation cannot be refunded due to the processing costs involved. All refund requests for App Store purchases are handled by Apple under Apple's standard policies. Contact Apple directly for refund requests.
Account Responsibility
7.1 You are responsible for all activity that occurs under your use of the app.
7.2 You must not use the app for any illegal or unauthorized purposes. You must comply with all applicable local laws.
7.3 You must not abuse, harass, impersonate, or intimidate other users.
Service Changes
8.1 We reserve the right to modify, suspend, or discontinue VIDIOAI or any of its features at any time without notice.
8.2 We may update these Terms of Use at any time. The Last Updated date at the top of this page will reflect the most recent revision. Your continued use of the app following any update constitutes acceptance of the revised terms.
8.3 We reserve the right to refuse service to any user for any reason.
Intellectual Property
9.1 All app content, features, branding, and interface elements are the exclusive property of King Apps Studio and its licensors, protected by applicable intellectual property law.
9.2 You may not copy, modify, distribute, or create derivative works of the app or its content without our express written permission.
9.3 Any feedback or suggestions you provide are voluntary. We may use such feedback without any obligation or compensation to you.
Disclaimer of Warranties
VIDIOAI is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the app will be error-free, uninterrupted, or that AI-generated content will meet your requirements. Use of the app is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, King Apps Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to loss of data, loss of revenue, or damages resulting from AI-generated content.
Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Malaysia.
