RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND WAIVER OF CLAIMS

READ CAREFULLY BEFORE SIGNING

In consideration of being permitted to participate in any way in programs, leagues, open play, clinics, tournaments, lessons, or other activities conducted or sponsored by Beaufort Pickleball Club (BPC) (the “Club”), I, the undersigned participant, acknowledge and agree as follows:

1. Assumption of Risk

I understand that participation in pickleball activities involves inherent risks, including but not limited to slips, falls, collisions with other participants, overexertion, dehydration, equipment failure, weather-related conditions, serious injury, permanent disability, paralysis, or death. I understand that these risks may arise from my own actions or inactions, the actions or inactions of others, the condition of the playing surfaces or facilities, or negligence.

I knowingly and voluntarily assume all such risks, both known and unknown, foreseeable or unforeseeable, even if arising from the negligence of the Released Parties, to the fullest extent permitted by law.

2. Physical Fitness and Medical Condition

I certify that I am physically fit to participate in pickleball activities and that I have not been advised by a qualified medical professional to refrain from participation. I accept full responsibility for monitoring my physical condition, hydration, and ability to participate safely.

3. Rules, Conduct, and Safety

I agree to comply with all posted rules, safety guidelines, and instructions provided by the Club, its officers, volunteers, or event organizers. If I observe any unsafe or hazardous condition, I will immediately discontinue participation and notify a Club representative.

4. Release and Waiver of Liability

I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby waive, release, and discharge Beaufort Pickleball Club, its officers, board members, volunteers, instructors, event organizers, sponsors, other participants, and any owners, operators, or lessors of facilities used for Club activities (collectively, the “Released Parties”) from any and all claims, demands, or liabilities for injury, disability, death, property damage, theft, or loss arising out of or related to my participation in Club activities, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

5. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising from or related to my participation in Club activities.

6. Photography and Media Release

I grant permission to the Club to photograph, video record, or otherwise capture my likeness during participation in Club activities. I authorize the use of such images or recordings, with or without my name, for Club-related promotional, educational, or informational purposes without compensation.

7. Governing Law and Venue

This Agreement shall be governed by and interpreted in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to this Agreement or participation in Club activities shall be brought exclusively in the state or federal courts located within the State of South Carolina.

8. Severability 

If any provision of this Agreement is held to be invalid, illegal, or unenforceable under South Carolina law, the remaining provisions shall continue in full force and effect.

9. Parental Consent & Acknowledgement

I am the parent / legal guardian of the minor participant named below.  I have read the entire agreement and understand I am surrendering legal rights on behalf of myself and the minor.

10. Acknowledgment and Understanding

If any provision of this Agreement is held to be invalid, illegal, or unenforceable under South Carolina law, the remaining provisions shall continue in full force and effect.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT IN ITS ENTIRETY. I FULLY UNDERSTAND ITS TERMS AND ACKNOWLEDGE THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS UNDER SOUTH CAROLINA LAW. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY, WITHOUT ANY INDUCEMENT.
