Under Section 22.1 of the Illinois Condominium Property Act, a prospective purchaser must receive, upon request, a copy of the declaration and by-laws and rules of the association. Regardless of whether the transaction is a sale or lease, a prospective owner or resident should receive the association documents in advance of the closing or commencement of the lease. The association will have fewer enforcement problems if prospective buyers and tenants obtain and review the rules in advance of the closing or lease occupancy.
