TSTC students have a right to file a grievance if they believe they have been denied equal access in the form of appropriate accommodations, modifications, auxiliary aids, effective communication, or have experienced discriminatory harassment as described in Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990, the Americans with Disabilities Act Amendments Act of 2008,
or the Fair Housing Act.
The student shall submit a written complaint to the Office of Access and Learning Accommodations (adarequest@tstc.edu) or to the ADA/504 Coordinator (ADACoordinator@tstc.edu) as soon as the complainant becomes aware of the alleged violation, but no later than 10 working days after the alleged action occurred. The timeframe for submitting a written complaint may be reconsidered for good cause as determined by the Office of Access and Learning Accommodations or the ADA/504 Coordinator.
The written complaint must include: the name and address of the person filing the complaint, a brief description of the alleged violation, and any documents supporting the complaint. The Office of Access & Learning Accommodations or the ADA/504 Coordinator shall assist the student in the interactive process in an effort to clarify and resolve the issue. At times, the ALA office may consult with the ADA/504 Coordinator, staff, and/or other pertinent parties to assist in the resolution process.
The ALA office or the ADA/504 Coordinator shall review the complaint and provide the student a response within 10 working days following receipt of the complaint. An extension of time may be made, not to exceed 15 working days, if the student is notified by the ALA office or the ADA/504 Coordinator.
If the student is not satisfied with the decision of the ALA office, a written complaint may be submitted to the ADA Coordinator within 10 working days of the decision (provided in step two). The time for submitting a written complaint may be waived for good cause as determined by TSTC’s ADA/504 Coordinator. The written complaint must include the name and address of the person filing the complaint and a description of the reason for the complaint. Upon receipt, TSTC’s ADA/504 Coordinator shall review the complaint within 10 working days. An extension of time may be made, not to exceed 15 working days, if the student is notified by the ADA/504 Coordinator. When necessary, the ADA/504 Coordinator shall consult with the ALA office and/or the ADA compliance committee to assist in the resolution.

The ADA/504 Coordinator’s decision shall be final at the college level. If a complaint is not resolved at the college level, the student may choose to file a complaint with the United States Department of Education - Office for Civil Rights, the Department of Justice, and/or the U.S. Department of Housing and Urban Development. Any of the listed entities will receive complaints and investigate as deemed appropriate.
