Law is an ass?

"The law is an ass" originates in Charles Dickens ‘Oliver Twist’. The Dickens quote is “If the law supposes that” said Mr Bumble...”the law is a ass, an idiot.” Thus, the law is stupid when the character Mr. Bumble is informed that "the law supposes that your wife acts under your direction". The truth of the matter is that the law is not an ass but many that administer it are just that! But then again, we must remember that we are all human and we all make mistakes. Let’s just consider one recent stuff-up of epic proportions where the law is concerned. It happened no less to Chief Magistrate Di Fingleton who had the dubious honour of becoming Australia's first serving magistrate to be jailed. Her case went to the Queensland Supreme Court and then the High Court of Australia before they got it right. The High Court finally ruled that she should never have been charged, prosecuted, convicted or sentenced in the first place. For that matter, she should never have been investigated ‘full-stop’ because she was protected by an immunity against prosecution under Queensland's Magistrates Act.

When she was originally found guilty and then her appeal was dismissed by the Supreme Court, these ‘turkeys’ missed the fact that she had immunity under the Act. Even Di herself will admit that she was a turkey too because she, herself, should have known what the Act stated.

Now do you see why you should question everything! Some of these turkeys out there are bloody dangerous. Don’t accept what so called learned people tell you but rather test their advice yourself. Anyone that tells you that you cannot win in a court of law against the banks is an ass! Anyone that tells you Storm were our agents is an ass! (Slater & Gordon  for instance). Anyone that tells you that you have no case is an ass! Anyone that tells you that you are wrong and they are right is an ass! I could go on infinitum.

The point is that they may well be right. They are an ass, however, for stating something with certainty that has not yet been proven in a court of law. That's why I have been so forthright in my assertions these last two years. Until I can be proven wrong, I have the right to say such things in a free society.

Don't get me wrong! You should certainly, listen to those that have more knowledge than you in these matters but just don't accept everything they say without question. Unless, that is, they just happen to be bankers whom you can always trust  to do the right thing. For them, that is! They will tell you any old rubbish to get you off their backs.
