ACTIVATION PERIOD AND PREPARATION OF THE PROPERTY FOR UTILITIES TEST

AGREEMENT

The Buyer and the Buyer’s Agent must acknowledge the following statements and agree unconditionally that; (1) The undersigned shall forever hold harmless the U.S. Department of Housing and Urban Development and BLM REO from any and all liability, damages and/or claims from the like, rather directly or indirectly, which may arise from the use of this form and/or the activation, connection and/or de- activation of any utility regardless of its origin or nature, (2) Utilities are defined as Water, Gas, Electric, and/or any other service, material, item or product required to operate and/or test any system and/or item on the above identified property, (3) The undersigned will assume full financial responsibility for any/all damages which may occur as a result of any actions and agrees to pay for the remediation and/or correction of any and all damages caused during the time the utilities are activated or de-activated, (4) The purchaser is responsible for any and all costs associated with the turning on and or off, (5) It is the responsibility of the undersigned to ensure that the electric remains on in properties which have sump pumps when all testing is completed and they will be held liable for any/ all damages that may arise from electric not being maintained as a result of this utility activation request & (6) All utilities are to be turned on in the name of the purchaser and at the purchaser’s expense.

It is the responsibility of the Buyer’s Agent to have the property prepared for utility activation (De-Winterized) which includes coordination of activities with the utility providers and your inspectors/appraisers. Once Turn ON/OFF dates have been determined, provide them in the area below. Do not have any utilities activated or services completed until you receive permission to perform these tasks. Utilities may be activated for the maximum of 72 hours excluding weekends and all federal holidays. All fees associated with activating any utility, including but not limited to, inspections, permits, deposits, service fees, and/or applications fees required by a utility provider are the responsibility of the buyer. BLM does not coordinate any dates or facilitate any payments to any provider.

PLEASE BE ADVISED:

IT IS THE BUYER’S RESPONSIBILITY TO ACTIVATE THE UTILITIES AS STATED, BE PRESENT AT THE TIME OF ACTIVATION, AND IS AT THE BUYER’S EXPENSE. THE BUYER’S AGENT MUST BE PRESENT AT ALL TIMES WHEN ANYONE IS AT THE PROPERTY. HUD KEYS ARE NOT TO BE GIVEN TO ANYONE THAT IS NOT A LICENSED REAL ESTATE AGENT.

IT IS THE BUYER’S RESPONSIBILITY TO HAVE THE STRUCTURE PREPARED (DE-WINTERIZED) BY A LICENSED AND INSURED CONTRACTOR / PLUMBER PRIOR TO UTILITY ACTIVATION. BLM COMPANIES, LLC DOES NOT DE-WINTERIZE.

THE BUYER/BUYER’S AGENTS ARE REQUIRED TO HAVE THE HEAT ON AND OPERATIONAL BEFORE THE WATER IS ACTIVATED. IF FOR ANY REASON THE HEAT IS NOT FUNCTIONAL DO NOT ACTIVATE THE WATER. (FROM SEPTEMBER 1ST, TO MARCH 31ST)

IT IS THE BUYER/BUYER’S AGENT’S RESPONSIBILITY TO MAINTAIN THE HEAT IN THE STRUCTURE AT 65 DEGREES AT ALL TIMES DURING YOUR ACTIVATION PERIOD. (FROM SEPTEMBER 1ST TO MARCH 31ST)

IT IS THE BUYER/BUYER’S AGENT’S RESPONSIBILITY TO TURN THE WATER OFF AT ANY TIME THE STRUCTURE IS NOT OCCUPIED.

IT IS THE BUYER’S RESPONSIBILITY TO CONTACT THE UTILITY PROVIDERS AND HAVE THE UTILITIES TURNED OFF. THE UTILITIES MUST BE TURNED OFF ON THE DE-ACTIVATION/TURN OFF DATE. IF BLM COMPANIES, LLC FINDS THE UTILITIES ACTIVE PAST YOUR DEACTIVATION/TURN OFF DATE, YOU MAY BE SUBJECT TO ADDITIONAL FEES/CHARGES. THE BUYER’S AGENT IS RESPONSIBLE TO ENSURE THAT THE UTILITIES ARE TURNED OFF ON THE DE-ACTIVATION/TURN OFF DATE. FOR PROPERTIES WITH SUMP PUMPS ONLY:SUMP PUMPS MUST REMAIN OPERATIONAL, DO NOT TURN THE POWER OFF. THE POWER MUST BE SWITCHED FROM THE BUYER’S NAME BACK INTO BLM COMPANIES, LLC/HUD’S NAME FOLLOWING YOUR UTILITY ACTIVATION PERIOD.

IF THERE ARE ANY PROBLEMS OR IF ANY DAMAGE OCCURS DURING THE UTILITY ACTIVATION, THE BUYER/BUYER’S AGENT MUST NOTIFY BLM COMPANIES, LLC IN WRITING IMMEDIATELY. NOTIFICATION MUST BE IN WRITING AND SENT TO5P UTILITY ACTIVATION <5PUTILITYACTIVATION@BLMCO.COM

TO CANCEL YOUR SCHEDULED UTILITY ACTIVATION, YOU MUST PROVIDE BLM COMPANIES, LLC WITH AT LEAST 1 BUSINESS DAY NOTICE PRIOR TO YOUR REQUESTED ACTIVATION DATE. NOTIFICATION MUST BE IN WRITING AND SENT TO 5P UTILITY ACTIVATION <5PUTILITYACTIVATION@BLMCO.COM

TO REQUEST AN EXTENSION OR CHANGE THE DATES OF YOUR SCHEDULED UTILITY ACTIVATION, YOU MUST PROVIDE BLM COMPANIES, LLC WITH AT LEAST 1 BUSINESS DAY NOTICE PRIOR TO YOUR REQUESTED TURN OFF DATE. NOTIFICATION MUST BE IN WRITING AND SENT TO 5P UTILITY ACTIVATION <5PUTILITYACTIVATION@BLMCO.COM

ALL PROPERTIES ARE SOLD AS IS AND YOU ARE NOT AUTHORIZED TO HAVE ANY REPAIRS MADE AT ANY TIME PRIOR TO CLOSING.
