On the south side of the Montauk Highway, west of Seatuck Avenue, and directly across the highway from the farm stand, is a 1 acre lot that was downzoned zoned at the owners' request from A-1 to J-2 in 1995. The owners agreed and covenanted that the property would "be used for recreational purposes only". In 2004, the current owner purchased the property, subject to the covenant that had been recorded with the County Clerk.
Now the owner wants the Town Board to relieve it of the covenant it bought subject to so it can build a 5,342 square foot office building.
The zoning in the area is predominately residential, although there are a few spot J-2 zoned lots. A fundamental problem is that the Town has no coherent plan for the area.
A residence is located on the adjacent lot to the west. An historic residence has just been moved diagonally across the highway from this site. A number of residences fronting on the Old Montauk Highway extend through to the Montauk Highway nearby.
The hearing on relief from the covenant is now on the Town Board's agenda for Tuesday evening, October 28, but is expected to be adjourned again to November 25. The hearings start at 6:30 pm.
