Effective June 03, 2017, there is a new sub-section to the Amendment to the Cherokee Springs Architectural Review Committee Standards and Procedures.
Section “III. Design Guidelines” of the Architectural Review Committee Standards and Procedures shall be amended to add a new sub-section
N. Fencing: Fencing is not required, but any fences erected shall be constructed of wood, prefinished aluminum, or prefinished vinyl. Fences shall be picketed with the framing facing the owner’s property. In addition, the owner may choose to install pickets on the frame (owner’s) side of the fence if desired. The top of fencing shall be a minimum of 4 feet, to a maximum of 6 feet, above the ground at the fence site. The bottom of the pickets shall be no more than 3 inches above the ground at the fence site. Fencing shall be located and laid out on the owner’s property so that the fencing is: (1) in compliance with all applicable codes and regulations; (2) in compliance with all CSOA agreements and standards regarding pedestrian easements; (3) no closer to the front yard than the line where the driveway and back yard meet, on the side of the house where a driveway exists; and (4) in any case, no closer to the front yard than the plane established by the house’s front wall. Fence designs and layouts approved by the ARC prior to issue of this sub-section “N” are grandfathered and permitted to remain in place while they are properly maintained. All new and replacement fences erected after the issue date of this sub-section “N” are subject to these requirements. All fencing, whether erected before or after issue of this sub-section “N”, is to be repaired, cleaned, stained, sealed, etc. as necessary to maintain the appropriate appearance and functionality. If fencing is not maintained properly, the Board shall have the right to require the owner to remove said fencing.
