The sources of South African Law affecting education
In the Constitution, The Bill of Rights it states that children have the right to basic education, to further education, receive education in the official language of their choice etc.
We as students studying to become educators we should be quite familiar with the labor laws and regulations that determine the terms and conditions of employment in order to act professionally and function optimally within the confines of the law.
By knowing the legislation affecting educators. And to be accustomed to all the Acts relating to the employment, rights, etc.
Classroom management
With regards to the legislation regarding the classroom, and with reference to the South African Schools Act. The Language used within the class, for the teachers and the learners is very important. Other factors is the teaching equipment, the building/infrastructure, resources, teaching material, teachers, classroom size and many more to help make the learning environment set for the learners.
The teacher should be equipped with many ways, strategies and methods to keep learners academically productive, attentive and organized
Within the classroom, the teacher has her day set out and has prepared the lessons, cycles, activities, methodologies, strategies, time management, approaches and many more. The teacher manages the learners reading, writing, and numeracy activities and tasks. As well as accommodating each learners academic needs.
Curriculum and Assessment
The use and teaching of the curriculum and the standards or assessment are also very important. It is the Foundation Phases teachers job and responsibility to manage the CAPS curriculum correctly and effectively when teaching.
By using the aid of the CAPS document, the teacher has all the necessary ways and concepts to teach the learners effectively. It is used as a guide or reference with lessons with topics, themes, time, tasks and more.
With regards to Assessment, there are many ways the learners can be assessed on their work, as feedback on their understanding on what has been taught. Formal and informal ways of assessing certain work, depending on the curriculum, subject and teacher.
Learner behaviour
With regards to the legislation regulating learners behavior, there are certain factors and protocols that have to be in place according to the South African Schools Act: Code of Conduct. Such as a consultation with the learners, parents and educators of the school. The aim is to establish a disciplined and purposeful school environment, dedicated to the improvement and maintenance of the quality of the learning process.
The constitution states that it is the teachers responsibility to supervise and discipline the learners. Taking on the role of an educator who is fair, just and reasonable. Enforcing punishment that is appropriate, reasonable and according to the Case law and that punishment methods do not go against the learners constitutional rights.
The Foundation Phase teacher should create a positive and effective atmosphere and classroom space for the learners and to have a code of conduct. The teacher should be inclusive and open to all learners no matter their background, race, gender and more.
Learner safety
The legislation regulating the learners safety. Foundation Phase learners are seen as the most vulnerable out of the learners at the school. It is important that the teachers ensure that the learners are safe, protected and cared for at all times. Especially given that the majority of South African schools are in violent communities and are unsafe. There should be regulatory and policy measures put in place to make sure learners safety is a priority and their environment should be conducive for effective and stress free learning.
Health and Safety measures should be in place, regarding the facilities, apparatus in and outside of the classroom should be maintained. School grounds are to be maintained, security if needed, etc.
Teacher’s employment and behaviour
The legislation regarding employment and behavior have many relating acts: The Employment of Educators Act, The Labor Relations Act, The Basic Conditions of Employment Act, Occupational Health and Safety Act, Unemployment Insurance Act, Skills Development Act, Employment Equity Act, Public Finance Management Act.
All these acts refers the employment regulations for teachers and their behavior and duties and educators in South Africa.
