The purpose of any academic intervention is to provide a student with the tools needed to successfully access Level 1 or Universal Instruction. Level 3, or Intensive Instruction, is for students who have received a Level 2, or Targeted Instruction at fidelity and are not responding to the targeted instruction after 9-12 weeks. The purpose is to close any learning gaps strategically so that students are successful with grade level standards and instruction. The Instructional Framework, when implemented with fidelity, is to provide exactly what the student needs to be successful with the Universal content and is not to be used as a means solely to get a student considered for a Special Education Identification.
Level 3 Academic Intensive Instruction must be used in the following circumstances:
Level 3 Academic: The Academic BIT has determined that the Level 2 Academic MLSS Process was conducted with fidelity, including the implementation of Level 2 Targeted Instruction. Fidelity includes the core instruction, small-group work, data chats with the teacher, and monthly progress monitoring. Based on progress monitoring data, the Academic BIT decides the student needs additional support services via a Level 3 academic Intensive Instructional Strategy. The Academic BIT contacts and informs the SPC a student is in need of Level 3 Intensive Instruction. The Level 3 Academic Smartsheet submission must be completed by the BIT Academic Team.
SLD Referral: If a student is referred for a suspected special education need in the area of Specific Learning Disabilities, a Level 3 plan must be developed in Infinite Campus and the student must begin Level 3 instruction immediately. The evaluation team special education supervisor completes/submits the Level 3 Academic Smartsheet submission form for the student.
Special Education Reevaluation/Add on: If a student is already identified as Special Education in an area(s) other than SLD and SLD is to be considered by an IEP team, then the Level 3 Academic protocol must be followed. In these cases, the special education case manager completes the Notice of Reevaluation for the student and then notifies the school-based special education supervisor. The special education supervisor completes/submits the Level 3 Academic Smartsheet submission form for the student.
All Tier 3 Academic Intensive Instruction must adhere to the following standards:
Must be given by a licensed teacher (Reading/Math/General Certification) for that grade level.
Provide a substantial number of instructional minutes beyond what is provided to all students.
Use scientific research-based instructional (SRBI) strategy or evidence-based instructional strategy.
Use with individual or small groups (no more than 3 students in a group).
Focus on a single or small number of discrete skills closely aligned to individual learning needs (consistent with the area of SLD concern).
Use culturally appropriate material.
Implement with adequate fidelity.
Apply in a manner highly consistent with its design.
Level 3 Intensive Instruction must be an evidence-based or scientifically research-based instructional (SRBI) strategy layered on top of Level 2 Targeted Instruction. They target specific skills, are more intense, more frequent, and delivered one-on-one or in very small groups. Please see the Level 3 Checklist to ensure all steps of the Level 3 process are followed.

Identify students who have participated in Level 2 Targeted Instruction with fidelity and have not shown growth on multiple data points after 9-12 weeks. These students should be referred to Academic BIT. If the Academic BIT determines that Level 2 supports alone are not sufficient, the student then begins the Level 3 process with first SRBI.
Diagnose
When it has been determined that a student should proceed with the Level 3 process, staff members must diagnose their specific area of need. The area of need is determined through analyzing universal screener baseline and monthly progress monitoring data, as well as reviewing classroom assessments (formative and summative) and Targeted Instructional data.
Match
After diagnosing a student's specific area of need, the classroom teacher, in consultation with the Academic BIT, determines which SRBI is best suited for the individual student and their academic needs. See Level 3 Intervention and Progress Monitoring chart. The classroom teacher creates an intervention plan in IC. Three baseline scores at grade level are collected using the prescribed progress monitoring tool and entered into the Intensive Instructional plan in IC. A Level 3 Intensive Instruction notification letter is sent home and documented in RtI Contact Log in IC. If support is needed, please contact your SPC.
Intensive Instruction (SRBI)
Level 3 SRBI must be layered on top of the Level 2 Targeted Instruction and delivered with fidelity. SRBIs are evidence-based or scientifically research-based instructional strategies that have a high probability of success to support student growth. Students will receive their SRBI at their instructional level from a highly qualified licensed teacher according to their instructional plan for a minimum of 10-12 weeks.
Progress Monitor and Record
Weekly (Consecutive) progress monitoring at students' current grade level is used to assess students' responsiveness to the instruction. The progress monitoring tool used will vary based on the area of concern. See Level 3 Instruction and Progress Monitoring chart.
*Progress monitoring data must be recorded in the plan weekly. If a student is not available for instruction or progress monitoring, that should be recorded in the plan (in the comment section (RtI Contact Log)) as well.

Evaluate
To determine whether a student is responding to the first SRBI, the Academic BIT should review the fidelity of the instruction and the data charted using the WI DPI SLD Graphing Tool..
If a student is responding after the first completed SRBI, the teacher should collaborate with the Academic BIT to plan the student’s second SRBI. The SRBI remains unchanged, however, the frequency and/or duration should be intensified. Another option is, if the student is responding, increase the complexity of the intervention in the same area of concern. For example, if a student masters Elkonin Boxes with the first SRBI, then either Folding-In or Reading Racetracks would be options for the second SRBI.
If a student is not responding after the first completed SRBI, the teacher should collaborate with the Academic BIT to plan the student's second SRBI. The Academic BIT, in consultation with the teacher, may consider whether or not a referral for special education is appropriate at this time and submit an SLD referral, if necessary.
The following options for intensifying SRBI 2 could include (but are not limited to) the following:
Increase the frequency of the intensive instruction (times per week)
Increase the duration of or intensify the instruction (amount of time per day)
Change the SRBI
A second 10-12 week intensive instructional plan with three new baselines is then created in IC. The plan for SRBI 1 should be “ended” or “closed” by updating the end date to reflect the date of the last data point entered for SRBI 1. When creating the plan for SRBI 2, the new baselines can be the last 3 progress monitoring data points from SRBI 1.
