Re: Concerns regarding the detention of a Colombian human rights defender David Ravelo Crespo, and the threats and harassment to him and his family.

Dear Attorney General,

I, David Palmer, am writing on behalf of the Solicitors’ International Human Rights Group. The Solicitors’ International Human Rights Group (SIHRG) is a collective of lawyers, which promotes awareness of international human rights within the legal profession and takes effective action in support of those rights. The Group supports human rights lawyers overseas by conducting related missions, research, campaigns and training.

SIHRG have concerns regarding the detention of a Colombian human rights defender David Ravelo Crespo, and the threats and harassment to him and his family. He is a senior member of the Regional Corporation for the Defence of Human Rights (CREDHOS), which is regional human rights organisations based in Barrancaermeja, Santander province, Colombia.

Due to Mr Crespo’s work (which has included publicly denouncing human rights abuses by paramilitary groups) he and his family has been the subject of threats, including threats of death, and harassment since 2008. These crimes appear to have been committed by paramilitaries and their supporters. The Colombian authorities have implemented limited protective measure towards Mr Crespo and his family. However, these have been ineffective and there appears to have been no attempt to investigate these crimes and to bring those responsible to justice. Mr Crespo is the beneficiary of precautionary measures granted by the Inter-American Commission on Human Rights issued in 2000.

SIHRG understands that Mr. Crespo is currently the subject of a criminal prosecution based on the evidence, of demobilised paramilitaries[1]. We note that in the report of the UN Special Rapporteur on the Situation of Human Rights Defenders dated 4 March, she was extremely worried by the pattern of unfounded criminal proceedings being brought against human rights defenders for crimes against the Constitutional order (“rebellion”) and public security (“terrorism”) on the basis of military and civil intelligence reports and unreliable witness testimonies. Mr. Crespo is currently detained in prison in Bogotá and has been since September 2010. SIHRG has learnt that his appeal to the Supreme Court of Colombia has been rejected and that he is awaiting his pending criminal trial, which I understand is due to commence on 21 June.

SIHRG further notes that the UN Special Rapporteur on the Situation of Human Rights Defenders was also very concerned about the pattern of unfounded criminal proceedings being brought against human rights defenders on the basis of military and civil intelligence reports and unreliable witness testimonies.[2]

SIHRG also understand the Fiscalia’s Anti Terrorism Unit ordered the closure of the investigation phase without all available evidence in support of Mr Ravelo Crespo’s defence being admitted. Such an outcome serves to jeopardise the defendant’s right to a fair trial and right to due process.

Moreover, Mr. Crespo has already been the subject of one unfounded criminal prosecution in 1993, which resulted in his prolonged detention. He has been acquitted for this matter and was awarded damages against the State in June, 2010. His continued detention is hampering his ability to continue his work as a human rights defender.

SIHRG respectfully request that you ensure the responsible appropriate Colombian authorities:

· Provide effective protection to Mr Crespo and his family against the threats and harassment in accordance with their wishes;

· Investigate the allegations of threats and harassment and to bring those responsible to justice;

· Exercise caution when considering the extent to which the evidence provided by demobilised paramilitaries can be relied upon;

· Ensure that all available evidence is rigorously examined by the court, and that Mr. Ravelo Crespo is afforded a full and adequate right to a defence.

· Ensure that the trial is conducted in accordance with due process and international standards;

· Take steps to ensure coherent monitoring of ongoing cases and investigations against Human Rights Defenders, in order to close with maximum celerity those which are found to be spurious or lacking legal basis.

SIHRG will continue to monitor the developments on this case and encourages you to take immediate action.

Asunto: Inquietudes en cuanto a la detención de un defensor de derechos humanos colombiano David Ravelo Crespo, y las amenazas y acoso a él y su familia.

Estimada Fiscal General,

Yo, David Palmer, le escribo en nombre del Grupo Internacional de Abogados de Derechos Humanos. El Grupo Internacional de Abogados de Derechos Humanos (Solicitors’ International Human Rights Group, SIHRG) es un colectivo de abogados, el cual promueve la conciencia de los derechos humanos internacionales dentro de la profesión de abogado, y toma medidas efectivas en apoyo de estos derechos. El Grupo apoya a los abogados de derechos humanos en el extranjero por llevar a cabo misiones, investigaciones, campañas y formación relacionadas.

SIHRG tiene inquietudes en cuanto a la detención de un defensor de derechos humanos colombiano David Ravelo Crespo, y las amenazas y acoso a él y su familia. El es miembro sénior de la Corporación Regional para la Defensa de los Derechos Humanos (CREDHOS), la cual representa a organizaciones de derechos humanos basadas en Barrancabermeja, Departamento de Santander, Colombia.

Debido al trabajo del Señor Crespo (que ha incluido la denuncia pública de violaciones de derechos humanos cometidas por grupos paramilitares) él y su familia han sido el objeto de amenazas, incluyendo amenazas de muerte, y acoso, desde el año 2008. Estos delitos parecen haber sido cometidos por paramilitares y sus partidarios. Las autoridades colombianas han implementado, hasta cierto punto, medidas de protección para el Señor Crespo y su familia. Sin embargo, estas medidas han resultado inefectivas y parece que no ha habido ningún esfuerzo para investigar estos crímenes y llevar ante los tribunales los responsables. El Señor Crespo es beneficiario de medidas cautelares concedidas por la Comisión Interamericana de los Derechos Humanos, expedidas en el año 2000.

SIHRG entiende que Señor Crespo es actualmente el objeto de una persecución penal basada en las declaraciones de paramilitares desmovilizados[1]. Nosotros notamos que en el informe de la Relator Especial de las Naciones Unidas sobre las Situación de los Defensores de Derechos Humanos fechado 4 de Marzo, ella estaba extremamente preocupada por la pauta de enjuiciamientos infundados llevados a cabo en la contra de defensores de derechos humanos por crímenes contra el orden Constitucional (“rebelión”) y la seguridad pública (“terrorismo”) sobre la base de informes de inteligencia militares y civiles, y testimonios de testigos poco fiables. Señor Crespo está detenido en la cárcel en Bogotá actualmente, y así ha estado desde el Septiembre del 2010. SIHGR se ha enterado de que su recurso de apelación al Tribunal Supremo ha sido rechazado y que está a la espera de su juicio penal, el cual, según tengo entendido, se planifica comenzar el 8 Julio.

El SIHRG nota, además, que la Relator Especial de las Naciones Unidas sobre las Situación de los Defensores de Derechos Humanos también estaba muy preocupada por la pauta de enjuiciamientos infundados llevados a cabo en la contra de defensores de derechos humanos sobre la base de informes de inteligencia militares y civiles, y testimonios de testigos poco fiables.[2]

El SIHRG también tiene entendido que la Unidad Anti-Terrorista de la Fiscalía ha ordenado el cierre de la fase de investigación sin que fuesen admitidas todas las evidencias disponibles a favor de la defensa del Señor Ravelo Crespo. Tal resultado sirve para poner en peligro el derecho del acusado a un juicio justo y el derecho al debido proceso.

Además, Señor Crespo ya ha sido el objeto de una prosecución penal en 1993, la cual ha acarreado su detención prolongada. Ha sido absuelto de aquel asunto y en 2010 se le concedió daños y juicios contra el Estado. Su detención constante está obstaculizando su capacidad de seguir con su trabajo de defensor de derechos humanos.

SIHRG solicita respetuosamente que usted se asegure de que las autoridades colombianas apropiadas:

· Ofrecen una protección eficaz al Señor Crespo y su familia contra las amenazas y el acoso, de acuerdo con sus deseos;

· Investigan las acusaciones de las amenazas y el acoso y llevar a los responsables ante la justicia;

· Tienen cuidado cuando consideran el grado en que se puede confiar en las pruebas aportadas por los paramilitares desmovilizados;

· Se aseguran de que todas la evidencia disponible está rigurosamente examinada por el tribunal, y que al Señor Ravelo Crespo se concede un derecho completo y adecuado a una defensa;

· Se aseguran de que el juicio se lleva a cabo de conformidad con el debido proceso y las normas internacionales;

· Toman medidas para asegurar la vigilancia coherente de los casos en curso y las investigaciones contra los Defensores de Derechos Humanos, para cerrar con celeridad máxima los que se encuentran ser falsos o carentes de fundamento jurídico.

SIHRG seguirá de cerca la evolución de este caso y le invita a tomar medidas inmediatas.
