WA SUPER Act

During the 2015 legislative session, the Washington Legislature passed Engrossed Senate Bill 5419 (ESB 5419), the Student User Privacy in Education Rights Act (SUPER Act). This bill puts requirements on school service providers with respect to transparency, choice and control, and safeguards of student personal information. “School services” are defined as certain websites, mobile applications, or online services that are marketed primarily for use in a K–12 school, used at the direction of teachers or other employees of a K–12 school, and collect, maintain, or use student personal information. In order to strengthen protections around student information, the SUPER Act establishes some requirements for school service providers.
