Ordinance

The second step to establishing a CPAC is to pass an ordinance that will further detail the functioning of the CPAC. Below you will see a summary of the draft CPAC legislation and a working draft of detailed CPAC legislation. The final CPAC ordinance will cover the specifics of the legislation below which are not already established through the charter amendment.

Summary of DRAFT ordinance

1: Organization and Election

CPAC consists of a total of 13 elected members. serving for four year terms. Members will be paid the same base salary as members of the Minneapolis City Council. To qualify to run for office candidates must have specified experience or expertise serving and advocating for community members most impacted by police crimes. Former law enforcement officers are disqualified from running for CPAC.

2: Powers and Duties

The powers and duties of CPAC include the power to determine policies and budget of the PD. CPAC will also receive and register all complaints, conduct investigations, and recommend discipline.

3: Investigations, Hearings and Discipline

CPAC will engage in a hearing procedure as part of the investigation process. CPAC will investigate all complaints against members of the PD, as well as specified cases where a complaint is not necessary, including all cases where a PD employee draws, discharges or uses any weapon.

4: Community Input, Engagement, and Outreach

CPAC will appoint a Director of Community Engagement, who will share information on complaint and investigation processes with the community; solicit public input about police practices; and make sure at least four community meetings are held each year.

5: CPAC Reports

All reports, investigations, policies, and procedures of the CPAC will be open to the public except where prohibited by law. CPAC will be responsible for publishing videos, reports, 911 records, use of weapons records, and chief of police response reports. CPAC will maintain a police department complaint database.

6: Removals, Penalties, Rules

CPAC will publish a list of actions that would cause CPAC members to be removed from office.

7: Budget

Each fiscal year, the City Council shall appropriate an amount that shall pay for the expenses of the CPAC.
